Edit: if it was there, its likely in ambiguous, non-quantified terms like "Drake shall be allowed access." Something like that where a request to dial it down wouldn't amount to outright breach.

Oh, I agree. But I don't think it would be a lawsuit by LaRoche, but instead a grievance from MLBPA challenging management's right to unilaterally change a past practice, generally.

This should be an easy case, either it is in the contract or its not. Unless this is some sort of bizarro world where they had junior high school students drafting the contract there will be something called a integration/merger clause so either its in the contract or its not.

Not necessarily. Custom and practice and unwritten "rules of the shop" play major roles in labor relations cases, particularly grievances. However, as I said previously, the fact that he quit effectively dooms any meaningful remedy for him.

If LaRoche was promised that privilege, everyone in the Sox organization (especially the players) were aware of this fact, as well as some of his ex-teammates like Harper or Boyer...would the White Sox be covered legally because there wasn't an explicit promise written into the contract?

 

 

At any rate, it still makes the White Sox look bad if that was the case. They shouldn't have offered that "open clubhouse" policy in the first place unless they were willing to deal with the consequences.

 

KW comes off here as more of a bully who's hiding behind not wanting to set a precedent for other players (in the future) when that's exactly what they did in the first place apparently.

 

 

As an employment lawyer, I'll weigh in:

 

If he was promised that privilege, he would have the right to file a grievance over its breach to have it fulfilled. But the labor law maxim: "Work now, grieve later" applies. And even if that unwritten clause were insanely judged to be a "material" term or condition of employment, the law wouldn't allow him to unilaterally decide not to perform, but still collect pay for performing.

The only record that I can see of Garland on guns is: (1) he voted to rehear Parker v. District of Columbia en banc (meaning with all 10 members of the DC Circuit rather than the panel of 3 that issued the original Parker decision); and (2) he joined in an opinion upholding the FBI's background check system for gun purchases as not violating a federal prohibition on creating a gun registry.

 

Based on the above, I can see why the right might be worried, and in confirmation hearings want to flesh out Garland's position on Heller and other second amendment cases, but I don't see anything in his record that labels him as definitively anti-gun, a threat to overturn Heller, or as a threat to take anyone's guns...

 

Agreed. And he has a record as being a fairly tough prosecutor.

Maybe I am just getting old (I am 45 years old) but I amazed at how many times I find myself wondering how stupid people really are. I do not mean stupid in that they are uneducated but stupid in that they have a shortsighted idea of how the world works.

 

This campaign season is the prime example. I was trying to explain to my wife that there is no way Trump wins the general election. I hate Hillary Clinton but she will win in a landslide against Trump. Trump is the personification of the stupidity of the American people at this point in time. I still believe his run for presidency is simply an attempt to tear apart the Republican party and it is working like a charm. He is pandering to the least common denominator and doing it masterfully. The odd part about it is that he is not part of the religious right yet that sect seems to no longer be an issue.

 

Anyone that is voting for Trump in a primary is wasting their vote. I stated yesterday that Kahlish is the only viable Republican and he was overshadowed by the crap that has been run out there for the last few months by the republican party.

 

If the Republicans had any candidate worth anything, I think they beat Hillary in November.....Trump/Hillary will make Reagan v Mondale look like a race.

The football facilities are definitely in the bottom half of the conference. Werent they going to plan some additional work in the next several years?

 

You've got to remember that the fieldturf or the stadium itself isnt what people are referring to when they talk about the facilities "arms race." Its things like the dining area, the training area, the weight room, the indoor practice facility or facilities, the locker room, lounges etc. These have been getting MASSIVE in in the last several years. Many of the larger programs are pumping 2+ million dollars per year into incremental updates to some of those things not to mention every few years going big with 20-50 million dollar upgrades.

The second episode of The X-Files last night was great. Much like the original run, it was a standalone case while the overall series plot line was referenced. Mulder and Scully easily fell back into their banter, complete with Mulder's dry, sarcastic comments. It's a shame there are only four more episodes. Hopefully they'll bring it back again next season.

 

I agree. From the opening scene, it was a real return to form, and could have fit in well within any past season.
