No one is making any excuses for him. He should be fired, but charged with a misdeaenor like anyone else, not a felony. And because he is being charged with a felony, he will likely get off scott-free.

Okay, that is a fair statement. But I think he should be treated like anyone else since he was off-duty, and he was drunk. If he was on duty and sober, and just started whailing on an lady walking down the street, then yes, it should be a much more sever penalty.

Im really not sure about this so Im just asking, but if someone attacks an off duty cop does that warrant the felony charge? Because is so, then he should still be held to that standard.

Update from the Trib. The cop is of course charged with Ag Battery, as predicted. Now they are also adding all the charges for the attempted post-act intimidation, etc. And in fact, the prosecuters had to upgrade the charge to Ag Batt, because the PD had tried to file first as simple battery.

 

Good. This guy is getting what he deserves.

 

And the cops who tried the under-charge should be disciplined. How embarrassing.

The Associated Press reported that Abbate has been charged with trying to intimidate witnesses by threatening to plant drugs on bar employees and arrest customers for drunken driving.
