great question Steff No these are the Michigan statutes - I said the statute in one state - just as an example these are not the Colorado statutes although if I get a minute I will find those the basic 4 tier stage is typical however thus my example - petentration applies in 2 instances, and one CSC4, is a misdeamenor and I hope the youngins out there notice that a felony includes sexual relations with a person under the age of 16 and that is in every state I think - can be as mutual as all hell and if one party is uinder 16, it is a felony "rape" charge OK.. whew. OK, I see what you're saying. I went a step further since I have many times met the guys at their rooms and never, EVER had or expected to have sex with them.

Here's the charge. Level 3 - Aggravated Sexual Assault It is a crime if, while committing a sexual assault, the attacker wounds, maims, disfigures, or brutally beats the victim endangers the life of the victim. For a level 3 assault evidence of violence must be present. If not then it would be level 1. Level one means any type of sexual conduct (kissing, touching, fondeling etc.) that is non-consensual. As you can see.. it doesn't have to include any type of genitalia contact to be charged as sexual assult. CK.. any idea if these are federal levels, or just instituted at the state level?

exactly. that's what i didn't find it surprising when steff said 47% of them go unreported. i am no expert, i don't pretend to be, but apparently many victims just want to try and forget it ever happened. that, or they think nobody will believe them, or the perpatrator will try and hurt them again. the only thing that makes me wonder, is considering the severe emotional damage that occurs with rape, how could she go on vacation right after it happened? i'm not saying i don't believe her, because i don't know either way, but that seems a little out of character for a rape victim. but like i said i know very little. Spiff, as I heard it.. she went to the hospital, the rape test was administered, the police were called and a statement was given, etc... The next day her and her family left town. Who knows if it was a "vacation" or more getting the hell out of dodge before the s*** it the fan and media was all over their front lawn. If it were me.. I would have gotten the hell out of there.

That's what I thought. Even though the law is pretty clear on that I wanted to ask to comfirm. I don't know anything about how the process works during the initial report, or the rape kit test, but at the shelter I volunteered at in 2000 had a rape counseling area and the things I saw and heard.. OMG. I literaly had nightmares about them. A good movie to maybe give some insite would be "The Accused" with Jodi Foster. Her actions in that movie were very similar to things I saw and heard at the shelter.

oj could afford to buy his way out and did....i sat through months of watching that trial on court tv......despite the lapd being a mass bunch of clowns they did have enough evicence to put his ass away.... if it had been an average joe who couldnt afford that dream team believe me they would have been in the pokey......... All it takes is ONE mishap to create rumblings of "doubt". Furhman, Vanatter (sp?).. they are the SOLE reason OJ is not in prison today. Idiots.

OJ was/is guilty as sin.. but if the LAPD didn't have such a hard on about "making sure" I believe he'd be in jail today. Hopefully, thanks to CSI , law enforcement has learned how to handle evidence better and process information more efficently.

Thanks for the info CK. Now from reading the law again.. it does not protect "habitual" accusers, correct? I know it does not specify, but since court filings are public record, if a woman has accused someone falsly in the past it is my understanding that can be brought up. Interesting FYI though.. I have not found ONE filing of case law where an accuser accused more then once. One more.. the statistics say that more then 47% of rapes go unreported. That is scary.
