One of his former crimes..

 

"On Nov. 7, 1997, just before 9:30 p.m., Stinson, a 20-year-old Wal-Mart employee, left Livingston's pool hall in the 6200 block of 14th Street West and was walking south along Tamiami Trail to her cousin's house. Near Bowlees Creek, she saw a man standing on the sidewalk"

 

"Come over here," he said.

 

She refused and told him she had no money.

 

"I don't care," he said, then grabbed her and tried to pull her over the wooden railing and into a dark bed of reeds and bushes.

 

The attacker wore a light blue uniform shirt with a name tag and had short dark hair.

 

Stinson slipped and fell, and the man jumped on top of her. "If you don't quit screaming, I'll cut you," he told her."

Obtaining prescription drugs by fraud, isn't that what Rush was convicted of? I don't think the three strikes law would have nailed him. 1997 and 2004 were the only violent crimes. The rest were prescription drug convictions, unless the stun gun was a felony.

I stand by what I said. It doesn't matter who happens to be the perp.

That was just to put it in perspective. What I wonder is what violent crimes he may have committed between 97 and 04. And as I understand the 3 strike law, don't they have to be felonies? I'm not certain if the prescription violations are felonies. If not, a three strike law would not have put him in jail.

 

Basically it appears as if the Judge just saw some drug addict, hooked on prescription drugs.

Whether it is felonies or not depends on the state. Each of the states that enacted them are different.

Or how many he committed between '93 and '97 and didn't get caught for...

 

The battery and false imprisionment in 93 and 97 should have been enough.

 

Had it been.. this precious little girl may be alive today.

SARASOTA, Fla. -- The brother of the man accused of raping and strangling Carlie Brucia wiped his eyes Wednesday as he recounted how his sibling admitted during a jailhouse talk and later phone conversations to sexually assaulting and killing the 11-year-old girl.

 

John Smith said that his brother Joseph Smith told him that he had "rough sex" with Carly and then strangled her, making the confession during a telephone conversation from jail four nights after Carlie was abducted. The Feb. 1, 2004, abduction was taped by a car wash surveillance camera and later shown around the world.

 

John Smith testified the cell phone conversation took place as he was leading investigators to the location where his brother had told him the girl's body might be found.

 

Joseph Smith, a 39-year-old former auto mechanic and father of three daughters, is charged with first-degree murder, kidnapping and capital sexual battery in Carlie's death. He has pleaded not guilty; if convicted, he may face the death penalty.

 

Four days after Carlie's disappearance, Joseph Smith met with his brother and their mother, Patricia Davis, in jail after his arrest on an unrelated charge. Under their questioning, he confessed to his role in Carlie's disappearance, John Smith testified.

 

Mumbling and occasionally closing his eyes under questioning on the witness stand, John Smith reluctantly recounted the jailhouse conversation. His brother told him he had intercourse with the girl and made her perform oral sex. Crying, their mother left the room at the jail, and the brothers cried and "were hugging each other close," John Smith said.
