Tuesday afternoon, they are expected to hear the recordings of the actual conversations. Prosecutors were preparing to play jailhouse conversations that Smith had with his brother mother that, according to earlier testimony, include information about where Carlie's body was dumped and what happened to her. Defense attorney Adam Tebrugge objected to the recordings on constitutional grounds, saying Smith had not been advised of his rights and that Smith's brother was, in effect, acting as an agent of law enforcement. His objections were overruled. On what grounds were they overruled? I think this guy needs to be buried in the deepest hole and forgotten, but he should get a fair trial. And if common sense didn't kick in.. signs plain as day stating that visits were being monitored and recorded are all over the place. I am starting to think that the people responsible for paroling these repeat offenders need to start getting punished also. I am sure they would take their jobs a hell of alot more seriously if they were punished for letting some whacko out who went and repeated his crime. I was searching in my mind last night for something positive out of this whole tragedy. Joseph Smith might have made one contribution to America. With his idiotic coded letters, disgusting words to his brother, admission to his mother, and inability to spot surveilance cameras, he showed everyone in America how easy it is to violate a frightened child. He gave us a landmark case to refer to any time in the future. Never again should people entertain thoughts that brutal crimes bring about mountains of forensic evidence, or that a pervert set on kidnapping a child can't accomplish it without someone noticing. That car wash tape was easily the most frightening footage I have ever witnessed. His confidence, the ease of it, Carlies' innocent child-like responses when she felt threatened, Carlies' attempt to avoid his eyes and his person. If that tape doesn't scream to America that we need a one strike law for violent sex offenders, then we are headed down one ugly path. We rarely see a childs' final moments of innocent life. Kid Gleason Posted November 18, 2005 Share Posted November 18, 2005 I haven't watched the footage yet. I see that little picture of it in the corner of that update site, and I don't think I want to. Everytime I have tried, it hasn't worked, and I am pretty sure I am thankful for that. I just know I will end up yelling at the picture for her to scream, break away, run, do whatever she can.
