recently oldroman posted something about sex between other than married people being illegal in Virginia and some people doubted that, and I said that it generally is in each state. Problem is no states ever wrote out everything systemnatically, it is piecemeal all over the various statutes. However I happened to come upon a cite while searching for something else, this is a Michigan statute that has parallels in 49 other states and this is only a tiny % of the statutes that make sex illegal with other than married spouses -

Punishment—Any man who shall seduce and debauch any unmarried woman shall be guilty of a felony, punishable by imprisonment in the state prison not more than 5 years or by fine of not more than 2,500 dollars; but no prosecution shall be commenced under this section after 1 year from the time of committing the offense.

it is the search terms used - notice the word "sex" is not in the statute - as I say, theses types of scattered statutues are tough to find. For that one I was on michiganlegislature.org and they had a cite look up and someone from another office had supplied the cite so I just verified it.

 

one route to find it yurself - time consuming - is to check the reporting requirements for each state's sexual offender registry - but that probably would not reveal all of any state's statutes on sexual conduct, just theones they deemed reportable. The debate that led to this particular cite being raised was in a plea from a CSC3rd to seduction and would that avoid the SOL (sexual offenders list = s*** out of luck). In this case it did not.

If it matters, or makes a difference.. I used several different words other then "sex". No matter now. Interesting reading.

It's nice to know what a law abiding citizen I've been all these years.

Does that one year limitation apply in Illinois? If not, do they have computers in prison?

that is a Michigan statute. Parallel statues abound in each state, but as to specifics such as 1 year statute of limitation,s you'd have to find the Illinois cite.

Thanks cw. I didnt understand exactly what the punishment was, but it seems there were up to five years in prison. In Virginia, its just a fine and a criminal record. Geez, if five years in prison were dished out to every kid who has sex, I think my school would go out of business due to lack of students...

Good news for northsiders, it seems to be legal for a man to "seduce and debauch" another man. Except there is a Texas case before the Supremes.

In many states it is illegal to do just about anything except your spouse in the missionary position. Everything else is a no no.

the heart of the appeal to the Supreme Court I think is under the equal protection clause of the constitution as well as a violation of the constitutional right to privacy

 

I sure hope the Supremes do the right thing and strike the anti-gay laws down

prolly so.. youll have to check your local state though.. i know its like that in wisconsin.... they just had a trial not long ago where a boy did his girlfriend and got her knocked up ... they were gonna get married and her parents stepped in and made her put he kid up for adoption, pressed charges of rape against him and f***ed up his life for good by him tryin to stand by his woman and do the right thing..........most parents in that situation could only wish that the kid who knocked up their daughter would be so gracious to step up and take care of things...........

yes you can be charged.. that kid i posted about was 17 and his girlfriend was 16.....he was charged and did time in prison.....also has to register as a sex offender where ever he goes to live............tell him he cant be charged.,..... maybe you should have been his legal rep........
