Nope...states love putting drug offenders in jail. 420, be careful what ya do and make sure you never sell the stuff.

I didn't know what you were asking at first. I agree with RPS. Five pounds is alot of brownies, hard to pass off as occasional/recreational use. My guess is that he will get some serious charges but if it is his first offense he could get lucky and just get probation.

Well he's certainly no Nate Newton but 5 lbs. is quite a bit indeed. I'd have to agree with bjmarte tho and think that if this is his first offense and he had no intention of distribution then he may just get off with fines and probation.

If it's in Illinois, you're an adult at age 17..... according to the courts..... so he'll be charged as an adult. He's gonna be looking a County jail time no doubt. Whether he'll go to Stateville, Marion, or the like depends on his record. Look, your friend is a dumb asshole for having that much pot in the first place. 5 lbs? He's doing alot more than smoking it and, depending how he got caught, he might be looking at a possible additional charge of manufacture and/or intent to deliver/sale. The fact that he's a "good kid" who "graduated from school a year early" will have little bearing on the court based on the amount he had. Do the crime..... better be able to do the time. Tell your friend to invest in "chastity shorts" like Leslie Nielsen's in The Naked Gun movies..... he's probably gonna need them.

Well I think the fact that he graduated early shows that he's more mature and gives them more reason to try him as an adult.

 

The key is its a first offense and the question is whether he had the intent to sell it. If he was gonna sell it, he's screwed plain and simple, or thats my take on the situation.

According to the National Organization Reforming Marijuana Laws (www.norml.org), the pot laws for IL are as follows with the fines being the maximum they can mandate.

2.5 g or less misdemeanor 30 days* $1,500

2.5 to 10 g misdemeanor 6 months* $1,500

10 to 30 g misdemeanor 1 year* $2,500

30 to 500 g (first offense) felony 1 - 3 years $25,000

30 to 500 g (subsequent offense) felony 2 - 5 years $25,000

500 to 2,000 g felony 2 - 5 years $25,000

2,000 to 5,000 g felony 3 - 7 years $25,000

More than 5,000 g felony 4 - 15 years $25,000

Any conviction can cause additional fine of full street value.

Holy s***, if they nail him for trafficking, he could get 15 years. Hed get out when hes 32. Thats an entire life gone to waste. But thats unlikely. You said hes a good kid so hopefully hell behave well and get maybe an 8 year sentence with possible parole at about 4 years. But I still wouldnt want to spend four years in the pen... Sorry soxfan...

He has got to get the money to pay a good criminal defense lawyer. I work in a law office in Michigan and our laws differ, but it is safe to presume that 5 pounds is not going to be considered "for personal use."

 

The good lawyer can tell you if in Illinois you have the equivilant of what we have in Michigan. We would try to get him under two different provisions of the law. One allows a kid with no priors of any kind to go on extended probation and if he stays clean, the charges are dropped. the other is a specific drug statute that allows basically the same type of extended probation.

 

Howver, 5 pounds is a lot of grass. The prosecutor may kind of want some info in exchange, such as exactly where your friend came up with 5 pounds. This is no time for honor among thieves. Your friend was a dumb ass to get involved with an amount of this size and while his unsavory companions may not want him talking, it is your friend's ass who will be in prison otherwise.

 

And it depends on what county and how hard ass your states attorney is in that county.

 

Key: pay the big $$$$$ and get a good criminal defense attorney.

 

If probation is not possible (given the size of the bag) with good lawyering and luck and cooperation your guy might be sentenced to 1 year or less which should keep in the county jail which is a lot better than prison.

i have to agree with cw here... we all know too well that our justice system is based on those who can pay always land with the "get out of jail"

card... we know its not free but if you got the cash you can do the crime and get away with it.. just ask o.j...............better yet maybe ask him for his law teams #.........5 freakin pounds... what the f***....if your not going pass that out amoung friends then you deserve to get caught.. if for nothing else but being a bogart........lol....... :D
