The U.S. 9th Circuit Court of Appeals said the government's argument against Cervantes' negligence claim is "patently without merit" and "so off-the-mark as to be embarrassing." (AP) A car purchased at a U.S. marshal's auction four years ago had a hidden surprise for its new owner: 119 pounds of marijuana hidden in the bumpers. The buyer, Jose Aguado Cervantes, didn't know about the hidden stash until he was stopped at the U.S.-Mexican border three months later. Cervantes, 67, spent three months in jail as a result. Cervantes is seeking damages for the government's error, alleging negligence, false imprisonment and false arrest. While an appeals court in Pasadena said Monday that he cannot recover damages for false arrest and imprisonment, his negligence claim against the federal government "is an entirely different matter." The U.S. 9th Circuit Court of Appeals said the government's argument against Cervantes' negligence claim is "patently without merit" and "so off-the-mark as to be embarrassing." "Cervantes remained similarly unaware of the contraband until its discovery by U.S. customs agents as he tried to cross the U.S. border on Oct. 22, 1999," the appeals court said. "Although Cervantes denied knowledge of the marijuana and informed agents that he had purchased the vehicle at a U.S. marshal's auction, he was arrested and incarcerated." Government officials eventually dropped the charges, but not before Cervantes spent time in jail awaiting trial.

  3. I agree. Last year it was during the Expos at Comiskey series. I am surprized it is not during a game, but I wonder if our groundskeeper had something to do with that. He was unhappy last year and made everyoine get up at 6 am so he could groom the outfield. According to what I got today, we get to watch the Dodgers game on the scoreboard as well as watch a "baseball themed" movie.

  5. without looking this up, 67, Boston won the AL and that was the year (I think) that Gibson had the 3 wins in the series. In 68 Detroit won the AL, future embezzler McClain won 30 or 31, but in the series, it was the rotund Mickey Lolich who won 3 games to enable the Tigers to win the world series. Interesting that Lolich went into the donut business after baseball and McClain is on work release from prison selling donuts...

WHITE SOX SELECT CENTER FIELDER BRIAN ANDERSON WITH 15th PICK IN TODAY’S FIRST-YEAR PLAYER DRAFT CHICAGO - The Chicago White Sox selected center fielder Brian Anderson of the University of Arizona with the club’s first-round pick (15th overall) in today’s Major League Baseball First-Year Player Draft. Anderson, 21, batted .366 (85-232) with 14 home runs and 62 RBI in 57 games during his junior season. The right-handed batter collected 12 doubles, three triples and scored 58 runs with 17 stolen bases while leading his team to a 35-23 record and a berth in the NCAA Regionals. He posted a .425 on-base percentage and .668 slugging percentage for Arizona. „Brian is an impressive five-tool player,“ said Doug Laumann, White Sox director of scouting. "He hits for power, runs well and has a very strong arm. „We are pleased to add an individual with his athletic abilities to the White Sox organization,“ said Laumann. „He has proven he can compete at the highest levels, having had success in the Pac-10 conference.“ Anderson last week was named to the All-Pac-10 team along with three of his Wildcat teammates. The 6-foot-3, 200-pounder hit .342 with 23 home runs and 130 RBI with 31 stolen bases in three seasons at Arizona. „I had a feeling I was going to the White Sox,“ said Anderson. „Living five minutes away from Tucson Electric Park, I’ve had a chance to see a number of spring training games. I hope my advancement through the system will be quick, but I know the White Sox have a great outfield. I’m very familiar with Carlos Lee, Joe Borchard and Magglio Ordonez, but I really believe eventually I can use all five tools at the major-league level.“ The native of Tucson, Ariz. was a Collegiate Baseball First-Team Freshman All-American in 2001 and has played for Cotuit and the Bourne Braves in the Cape Cod League each of the last two summers. He was also a member of the silver medal Junior Olympics team following his senior year at Canyon Del Oro High School. Anderson joins left-handed pitcher Royce Ring (2002, 18th overall), right-handed pitcher Kris Honel (2001, 16th) and current Sox outfielder Joe Borchard (2000, 12th) as the last three first-round picks for the organization.   8. as long as it is done, I don't think it needs to be public. I was thinking today that it really makes no sense to fire JM first. If KW hires a new manager and then the Sox fire KW, we will have a manager not hired by the GM, and they may not be on the same page... as we have had the last couple of seasons. So I am thinking that KW needs to go first, get the new GM, and let the new GM hire the manager. That is today's reflection. Wish no one had to get fired but this team is playing way too weak for too long. So both need to go.
  9. I'm doing both. Just buy enough non fat soy milk in very large containers and live on that and all baseball things are affordable! No one really needs to eat anyway... Actually the tax-deductable status of the overnight makes that worthwhile. Just ordered my Michigan football tickets today and with everything, I am now officially tapped out. I may not even be able to afford the not fat soy milk for a few weeks - but what the hell!

  11. I am using OS 9.01 and 9.02 and it works - I suspect by next year I will have to upgrade to OS10 - no idea why it works for me and not you - ?

Every season the first two weeks I have problems with MLB radio and then they seem to fix whatever bugs it has and it works fine the rest of the season - I play it off of 3 macs: a G4, an iMac, and a powerbook, and no problems what so ever with real network or anything. Sorry that you have the bad experiences because I really rely on MLB radio to keep in touch with the games

    by the bmr, never ask a queston that you don't want the answer to - it is late here, 11:30, so 8:30 out west - when I check the board in the morning, if there is consensus it should be deleted, it will be and I'll take down any replies which have the pic in it - really didn't mean to offend, my mood was altered by reading the entire Limp Bizket discussion as well as some other prior threads

    that is a piece of art, not anything rel - given the general language on the site, I doubt we have many kids here if any at all - and given some other conversations, I don;t know why a piece of art would be troublng - but if it is, I will gladly take it down, delete the post, not my intent to offend - question though, if it were breasts, would it get the same reaction?
  20. 1. he is a huge baseball fan - note the Old English Detroit D tattooed on his arm 2. he will have no problems arguing with the umps on bad calls and making his point heard 3. No more stupid at bats or base running because he'd be hell to face in the dug out afterwards - the players would be too scared to do anything else but perform as they should 4. he is used to working with a posse - a 25 man team will be a peice of cake 5. attendance will increase, as will coverage on ESPN and all the other sports shows 6. KW says you can't spend a $1 when you have 50¢ - well, Eminem is producing 50¢ so we can add that to KW's 50¢ and maybe do something 7. the singing of Take Me Out to the Ballgame will be more fun 8. Eminem would have no problems flattening KW if need be 9. our players would work harder so they'd have as many autograph seekers as manager Em would have 10. tapes of his speeches to the team would be more fun that Lee Elia's to the cubs, and we could sell those to raise money for better players 11. He would beat the s*** of Rob Gallas as well as tell JR to f*** off, things long wanted on these boards 12. If we still lose, he could install Nelly as first base coach and when Nelly starts singing, Its getting hot in here, take off all your clothes, the fan experience might become very interesting. 13. A player continues to suck, Eminem is experienced at cleaning out the lockers, ah, closets.

    Find something on you body that looks like this: hopefully the one on your body will not be blue but will match you normal untanned body color. Apply a liitle hand lotion or vaseline in your hand and apply vigorously to the said (hopefuuly not blue) body part. You may think about Jose Valentin; you may think about Aaron Rowand's wife (if you've seen her, you know what I mean, he went major league in one area of his life), or reflect on the concept of a certain board member who is "doable" (for further insight, contast RPS). Do it for a few minutes and the end result should be, if you have done it right, something that resembles the release of whipped cream from a can of Redi Whip. I hope I have answered your question well enough.

Your artistic exertions have both been most satisfactory and you will not get me in the middle of an Alex vs Ian situation - I've been in the crossfire of Jose vs not Jose debate too much the last few days! You and Alex duke it out and leave my name out of it!
  24. I had it up as wallpaper within 2 minutes of first seeing it - it is awesome! The colors work well, I like the way the schedule is overlayed the batting Carlos, and it aesthetically pleased. You did a great job!
