If there is a 269-269 tie the winning ticket in the popular vote will get elected. Congressmen aren't just going to piss off their constituents and lose their jobs over something like this.

Absolutely they would. The same scenario played out in districts where they preferred one of the Presidential candidates but the Rep came out in support of the other during the Democratic Primaries.

In a heart beat, and they should. When the system was designed, this scenario, with the predictable resulting party line voting, was understood. Just like Dem Governor when given a chance, would nominate a Dem to replace an outgoing Rep (and vice versa).

 

They would lose their jobs if as a Dem they voted Rep. Their district elected a Dem and they will vote Dem.

The Senate votes the VP tie, the House votes the Prez tie. So Cheney only breaks a VP tie in the Senate.

 

And the house tie thing is really not going to happen anyway - the Dems are likely to add to their majority as it looks right now, not lose it. So the Pelosi thing is not going to happen. A 269-all tie will get you Obama/Palin.

 

Did anyone read the Constitution????? They keep voting until one candidate receives a MAJORITY of State Delegations - that's 26. (As voted by the NEW Congress)

 

The Senate picks the VP, so we could see McCain/Biden.

McCain likely would have the majority of states, whereas obama would have the two huge population states, Cali and New York.

I should have been more specific - I get McCain. What I don't get is Biden.

No, but it also wasn't constructed on the idea that tiny minorities (i.e. corn farmers in Iowa, a few thousand ultra rich bankers in NYC) should be able to dominate our political discussion with their issues while the issues that actually would affect the lives of so many other people (urban schools, adequate public transportation, pollution controls, etc.) are neglected because of them.
