You would presumably still have to convince a court that victim was not the one initiating the encounter, though. According to this website, it would seem that would not apply in New York as alcohol could facilitate date rape there but apparently only if alcohol was provided w/o consent (unclear how you'd go about doing that). They took her blood on sunday, not sure they would get anything other than the fact alcohol was ingested, unless there was video or photographic evidence of her passed out.

He said in his experience usually sex was going to happen, not that she consented or that it has to happen, hes just stating his statistical experience.

Even if he did rape her, its the kind of date rape where the presence of alcohol and the lack of actual injuries could get it completely thrown out. Thats why date rape is horrific for victims and the law in general. Alcohol, the consent involved in following someone to their home and the lack of any real injuries makes it impossible to prosecute. Now if he beat her or drugged her then he's toast as he should be.

So the Police statement is being run with by media outlets without actually reading it. The statement says they are investigating an incident that occurred at Kane's house but didnt actually say they were investigating Kane himself. Interesting detail there.

If they took her blood and there was alcohol and they dont find any signs of struggle or date rape drugs in Kane's house this is going to get thrown out regardless of what happened. I doubt there are any injuries on the girl that dictates rape.

Very few are ever actually charged. Ive heard the same. Alot of regret over one night stands and how big of a jerk the guy was and this is their first inclination, like "Ill show him." The kit usually shows something but even if its not much evidence its word against word and a good lawyer will get that tossed unfortunately. I attended a mandatory date rape seminar back in the day and the advice on how to react was contradictory at times, either dont do anything or make sure you scratch the offender to have proof. Its a very gray area.
