QUOTE(Rex Kickass @ Jun 6, 2006 -> 10:38 AM) How does that keep happening? We've agreed on more than we disagree on lately. Hello?!? End of THE WORLD today. Duh.

QUOTE(kapkomet @ Jun 6, 2006 -> 08:36 AM) Breifly, how can you guarantee someone's rights if they are not a US citizen as applied in Guantanamo? Now, the part about our conduct in battle, etc. and trying to tie it to existing accords, no, that's not unconstututional. But, I think that you can't write a law for combatants already captured and then turn around and say they have rights that they don't under the constitution. I may have drawn the wrong paralell. Dang I can't spele today. I see the line of reasoning, but I don't think it holds up. The protections for detainees afforded by the law do not claim to derive from the Constitution. And the law says as much, so as not to confuse things. The law does not grant forien detainees any Constitutional rights they did not have prior. And, of course, you are correct that that soldiers' conduct is guided by laws and accord both Constitutional and supraconstitutional, and they specifically ban detainee punishment that is

QUOTE(kapkomet @ Jun 6, 2006 -> 07:47 AM) And I will argue that McCain's APPEASEMENT POS legislation is unconstitutional. McCain is a f***wad. Briefly lay out this argument for me so I can better understand it. Not the argument for him being a f***wad, the argument for the unconstitutionality of the anti-torture legislation.

QUOTE(Rex Kickass @ Jun 5, 2006 -> 07:34 PM) Thank God for my Senators who are going to vote Hell No on the Federal Discrimination Amendment. To be honest, I doubt that amendment will even get 50 votes in the Senate. 52 is what the latest pollwatchers are guessing - not nearly enough to pass but a couple more than two years ago. But then again, I can understand there being more support now, since Tony Snow has now explained to us how this is a "civil rights" measure. And by "civil rights" measure, he apparently means using the Constitution to discriminate against a minority group and permanently legislate away their right to be treated as equals in society. I have a dream stuff if ever I saw it.

QUOTE(Balta1701 @ Jun 5, 2006 -> 12:37 PM) 2nd, this is exactly what Bush said he'd do in the signing statement he issued when McCain passed his last attempt at a "torture ban" bill a few months ago. Bush said he'd ignore it, and voila, the DOD is ignoring it. I think this is an important step down the 'slippery slope' from the standpoint of the ABA investigation as to the overreach of the signing statements. Presumably a lot of the 750 laws GWB said he intended to ignore via signing statements have not yet been ignored. This, on the other hand, is taking it to the next level and acting on the threat to ignore the law enunciated in the signing statement. As far as caring what is in the FM, I think average people only care when things get so out of hand on the ground that you go to the FM to try to find some justification as to some of the soldiers' behaviors in some of the military scandals that have come to light.

http://www.latimes.com/news/nationworld/na...-home-headlines The humiliating and degrading thing has worked out so well for us up to now - especially when soldiers' cell phone images and videos make worldwide news - that it only makes sense to officially wipe our asses with Geneva detainee rules. :banghead

It's a diversion, sure, but it's all about the '06 elections. Almost exactly 6 months away, so it's time to manufacture some matters of dire importance like flag burming and gay marriage. And I would love to say that it won't work and the American voters will see that this is just distraction from real election issue, but we saw first hand in '04 how many people came out of the woodwork to vote to "save the sanctity of marriage." :headshake

QUOTE(bmags @ Jun 4, 2006 -> 11:49 AM) if you consider being fan friendly overcharging everything. What about considering fan friendly as letting concertgoers openly tape their shows, even giving them the best acoustical seats in the house and letting some of them patch into the house soundboard? Most of the overcharging was out among the tradersin the lot, but the band was always more than fair to their fans. RIP Vince. Curse, yes. Hornsby has got to be hearing footsteps. . . .

QUOTE(LosMediasBlancas @ Jun 2, 2006 -> 02:57 PM) I also wasn't blown away by Boston. Where's the skyline? Where's Fenwayville? It feels like parts of the southside, except the whole city is that way. Lotta pubs and taverns. I think that is two reasons I like it so much right there!

get the lobstah and the chowdah! But seriously, it's an awesome town If you are going to a game – heck, even if you are not – stay at the Hotel Buckminster. It's literally around the block from Fenway. It's a 100 year or so old building and it's lacking in a lot of modern ammenities, but you can't beat the rates (they do go up a bit on game nights), and you get a free breakfast with each night's stay. Driving in the city sucks. If you are driving, park your car and do not drive the whole time you are there (you can get a discounted parking voucher at Buckminster). Get to know and love the "T" - Boston's subway system. Best US metro transit system there is. 15 minutes from anywhere. If you are flying in and don't have a ton of luggage, it's only a two train ride to the hotel and there is a stop a block away. Definately take the time to do the historic stuff – Freedom Trail, Revere House, old North Church, etc. The New England aquarium is top notch – right on the water. While at the wharf, take a 1/2-day whale watching trip out to Stellwagen Bank – seeing humpbacks in northern waters in September is still likely. Also get a meal at Legal Seafood at the wharf if you have never eaten at a Legal's before. Best seafood resturaunt on the planet! Couple of decent brewpubs. The best one is a small one out in Cambridge. The most convenient one, right by Fenway is Boston Beer Works. I'm not typically a light pubbrew drinker, but the brewmaster here does better with his light stuff. The Bambino Gold and his Berliner-style weiss (with a dash of soodruff or respberry syrup) are quite good. One of the best beer bars I've ever been to is the Anam Cara Publick House on Beacon Street (same street as Buckminster, a couple miles down). Massive selection of Belgian brews, plus all the New England stuff like Allagash, plus finally I found a place on the east coast the carries Stone's line in draft and bottles. That's all I can think of at the moment. QUOTE(Steff @ Jun 2, 2006 -> 01:07 PM) Expensive s*** hole. Not nice anywhere. Ate in a 4 star resturant and there were mice running around the dining room. Fenway sucks worse than Wrigley. Harsh, Steff. Fenway is Fenway. I've not run into the rodent-infested resturaunt problem, but that is probably because I can't afford the 4-star dining.

QUOTE(Rex Kickass @ Jun 2, 2006 -> 11:36 AM) Crazy Thunderstorm last night here. What would you listen to when you're driving through it? Two things come to mind: dEUS - Theme From Turnpike. A song about driving on the New Jersey Turnpike - dark and foreboding with a creepy Miles Davis sample. Mr. Bungle - California (Album) It's like Dick Dale and Brian Wilson had a Hungarian baby who joined a Klezmer band and scored a zombie movie. Those both sound pretty cool, especially Mr. Bungle by your description. If it was a big honkin' electrical storm with lightning strikes lighting up the place and thunder crashes everywhere, well then I think a Wagner opera is in order. And where are the fat viking lady smileys when you need 'em?

QUOTE(Rex Kickass @ Jun 2, 2006 -> 11:30 AM) I'm just happy to be the straight man in that exchange. That's right, you heard me. I'm just glad I didn't go with the alternate punchline. . . So then the Priest turns to the Rabbi and says, "Silly Rabbi, licks are for kids!" . . . because that would be bad.

QUOTE(Kid Gleason @ Jun 1, 2006 -> 04:27 PM) Ya know what honestly gets me? The fact that The Beatles are replaced by The Beatles basically, and that the rest of the Top spots are the same ol' bands as always, without Hendrix. Just once I want to see somebody step out and say "f*** it, the greatest album ever was Mott by Mott The Hoople" and for people to quit following along with what everybody else f***ing says. I'm soooo sick of the friggin' Beatles...and of that friggin' Hendrix guy. All the Young Dudes was a better album than MOTT.

QUOTE(Texsox @ Jun 1, 2006 -> 11:53 AM) Works for me as long as American business has access to a qualified, willing, labor pool. No bite on high end immigration? That is more fascinating to me. We fight for bottom jobs and ignore the better ones? Perhaps because these immigrants probably speak English and drive nice cars? We have lost lead we once enjoyed in the world higher education race, and will in short order lose the race itself. After 4th grade, American math/science/technology grades plummet. Other than mayber NSF's Project 2061, nobody is even trying to seriously address the issue. It will get worse over the next couple decades as the foreign doctors and engineers our schools currently train become the basis of new world-class academic institutions in their homelands. Then America will lose even the current job of being the M.D.- and PhD-mill for the rest of the world. So, all in all I guess the folks that are worried that their kids might lose that sweet lettuce-picking job to a Mexican immigrant have the right idea after all. Our schools sure won't be preparing them for much better prospects.

QUOTE(EvilMonkey @ May 31, 2006 -> 09:18 PM) Good for Damon. All that fat bastard (moore) did was complain that people were profitting off the war, when he himself profitted off it more than anyone. He stole clips, stole music, didn't get clearances and didn't get permissions to use what he did, he should pay. I didn't take time to question this when I read it earlier, but specifically WHAT music did he steal for the film? He very much wanted to use the Who's Won't Get Fooled Again as the closing music after the GWB "Fool me once. . . " clip, but Townsend refused to give him the rights to us it so he used Neil's Rockin in the Free World there instead. I doubt Moore used that song in a way Neil disliked, or he wouldn't have let him direct the new video for the song that came out a couple years back. My sincere question, Evil – what music did Moore steal for the film, and according to who? Thanks

QUOTE(Texsox @ Jun 1, 2006 -> 09:22 AM) I am certain he is going to need a lot of help in trying to live somethng close to a normal life with his disabilities. I agree with that. I also agree that his segment in F911 was very powerful and gut-wrenching and, imo, did not portray him unfavorably or as whining about his plight or his country's decisions regarding the war. I empathized very deeply with him, and with many of the soldiers depicted in the film. I only know Sgt. Damon from F9-11, and now from this lawsuit. There are thousands of similar stories I do not know about - in large part because the MSM has a gag order not to show any if the 'ickiness' if the war because people might get upset and question our continued presence. I don't know, but I wonder if the wider exposure of Damon and his story through 9-11 had anything to do with the nnprofit vet group picking up the ball and building him the house.

QUOTE(Texsox @ Jun 1, 2006 -> 08:44 AM) Overall, and not specific to this, but related. It would only seem fair that permission would have to be sought from individuals for derivative works. I know if my likeness or quotes were being used in something I'd be pissed if I wasn't asked. Plus ths blurs news and for profit works. I think it pretty much depends on the original release you sign, and all the fine print contained therein. If you have read any of the boilerplate language on those you know you pretty much agree to give up control of the use of your likeness in a variety of media uses beyond the original broadcast. This includes use as marketing materials for the broadcaster or its parent company or its affiliates, and it also usually includes general nondescriptive derivative uses that are consistent with the manner in which thir archive material is normally used. There is big money in archival and B-roll newsreel footage leasing. And it is getting bigger and bigger with all the Internet demand for broadcast content and also the increasing ease with which regular folks can get into the documentary business with minimal hardware and software expenditures. Most likely, Michael Moore's lawyers will produce evidence of the lease agreement with NBC and will refer Sgt. Damon to the release he signed with NBC. As far as using newsreel material in a way that the subject deems unflattering or otherwise objectionable, if it was that easy to sue over it then Michael Moore, Jon Stewart, and Stephen Colbert would be in the poor house. They are not. They and the companies they work for are meticulous in the way they secure usage rights to avoid such complications.

QUOTE(Heads22 @ May 31, 2006 -> 11:57 PM) Can anyone tell me if Combunox (ibuprofen and oxycodone) will be any fun when I get wisdom teeth pulled? That should take the edge off the pain for sure. It has 'short-term use only' warnings plastered all over it, so it's good enough that people can get hooked on it. One of the benefits of that combination would be analgesia (pain management) from both drugs, but also anti-inflammatory activity from the ibuprofin to keep swelling down. QUOTE(dasox24 @ Jun 1, 2006 -> 01:28 AM) I did all that. I checked it on both line 1 and line 2, but it was just a blue screen, which is what it looks like normally before I turn on my PS2. I guess that means the wiring or something is messed up b/c it seems to me like I hooked everything up correctly. Sounds like there is an input selection button present on the remote but not on the face of the VCR. Use the remote and find it to go through all the input options including Back A/V and Front A/V because it sounds like you don't jhave a full set of controls on the VCR.

QUOTE(Rex Kickass @ Jun 1, 2006 -> 06:04 AM) I think it's bulls*** that you have to get clearance to use anything broadcast publicly to begin with. I disagree for several reasons. First and foremost, we are talking about the livelyhood and stock-in-trade of broadcast companies. They spend large amounts of money putting programming together, and they need to be assured that there are protections against content vultures who would otherwise take and air large amounts of content second-hand at little cost to them. Making the secondeary market content prospectors get authorization to air content produced by the broadcast networks ensures that they know where and how and how much of their content will be used, and allows the networks to stipulate licensing terms, including whatever fees the parties agree to.

I'm pretty sure all Moore had to do was get permission from NBC for use of the footage. And as long as the clip itself is not doctored I think he'll be in the clear.
