Need legal experts to weigh in here: Do the couples who are getting denied licenses have grounds for a civil suit for damages? If so, isn't it in the county's best interests to find somebody to issue the licenses if she won't? It seems that, by doing nothing, the county is passively supporting her.

I have a lot more sympathy for a private business who tries to pull this, though still not a whole lot. I have zero sympathy for someone at the governmental level who does this. Governments shouldn't have religious bias, and as an employee of a government you represent that nonreligious government.

She's not just a clerk in the office, she's the elected County Clerk and her name is on all official forms that come out of that office. It's not a matter of the people applying for the license just going to the employee at the next window, it's that per her instructions, marriage licenses for same-sex couples will not be issued from her office at all. If you're same-sex and live in that county, you have no other option.

I understand that, but it seems like the county should have some kind of option for doing work that an elected official is refusing to do. A judge ought to have the authority to either remove and replace her, or at least give somebody the authority to issue the licenses in order to protect the county from liability.

The judge probably has the ability to throw her in jail for contempt of court, but if they're an elected judge, I'm doubtful that they would take that risk.

Yeah you would think. Where are the other county officials? Why aren't they stepping in to put some pressure on her? Or even the state. Surely they'd have some recourse against the county if she continues to refuse to do her job.

Maybe sending her to jail allows Davis to portray herself as some sort of a martyr whereas paying a fine isn't nearly as much of a spectacle?

 

It's dumb grandstanding like this that's part of the reason greg's religious poll has the numbers it does. Religious homophobia has driven a lot of people away.

Except that in the Bible the sexual act is the sin and not the marriage. And since we all know how much less sex there is once you get married, she'd be helping them out by issuing the licenses.

i wish there was some sort of clause that stated if she was unwilling to do her job based on religion, that she could be impeached. You know that whole separation of religion and state thing.

If she isn't fulfilling the duties of her office, she should be able to be impeached. The problem is that it takes someone with the political willpower to do it, and most politicians are too scared for that.

Amazed that after all this it's basically just a handful of judges that have been an issue. Again, amazing the progress in 10 years.

Monetary sanctions are probably a harsher penalty for her than jail... particularly since no one seems to be in a hurry to start impeachment proceedings.

edit: apparently the Kentucy state legislature is on their regular recess until next year, so barring an (expensive) special session just to impeach this county clerk, the earliest they could even vote to impeach her is months from now.

Christianity has split up in to so many sects and denominations, so there is no universal standard, but in general, divorce and remarriage are only acceptable if the other spouse committed adultery or abuse. Of course death of a spouse is also an acceptable reason to get married again. I don't know her particular situation, but it's highly improbable that all of her marriages would be considered acceptable by the general Christian viewpoint, so it really isn't that petty for you to bring this up. It's a symbol of the serious problem of heterosexual Christians screaming about one of God's rules for marriage while at the same time ignoring others.

No...not petty. If you are going to claim gays are ruining the sanctity of marriage when you yourself are ruining the sanctity of marriage, then you are a total hyprocrite and any religious / personal stand goes away because you don't act in that manner. What a pathetic person.
