There's already deterrence built into the system.

It's at the judge's discretion to determine whether the plaintiff understood the waiver, appreciated the risk, etc. In my experience, and ironically enough, waivers are more likely to hold up when the plaintiff is a lawyer. The Cubs are supposedly 50:50 on whether they will offer him a contract by the deadline tonight. Apparently the sticking points are whether he's worth $3.25 million a year and whether Prior will sign off on a 2009 club option. The risk is obviously his health, but James Andrews said he will be good to go by May. And although he has a history of trips to the DL, this shoulder procedure he just had to clean things out was the first surgery he has had. I think he's worth the risk. Give him a 3 year deal and roll the dice. Obviously we have struck out with free agents and trades elsewhere and have to be more creative if we're going to upgrade this currently second rate team.
