"We expect him back on Wednesday," said Karen Mateo, a spokeswoman for Infinity Broadcasting, which carries Stern's syndicated show in more than 20 markets. She wouldn't call Stern's absence a suspension and declined to comment further. Listeners will hear a compilation of Stern's best shows on Tuesday, she said. But Stern's spokesman Matt Traub called it was a paid suspension. "This is an act of desperation by men who are losing their once-in-a-lifetime franchise," Traub said Monday. It was first reported on the Howard 100 channel carried by Sirius Satellite Radio, where the shock jock is moving his show next year. It said that Stern was suspended for talking too much about his impending move to satellite. Stern announced his departure last year to Sirius, where he received a $500 million contract to begin in January 2006. Stern boasts an audience of about 12 million and revenues of about $100 million from his morning radio show. His last live radio show for Infinity is scheduled for Dec. 16. Sirius spokesman Patrick Reilly declined to comment Monday.

Bundles of flowers still sit along the side of the road near Lunsford's Homosassa Springs home and a picture of her is in front of her house. Now, a new playground built in her memory at the school she attended, Homosassa Elementary, will keep her on the minds of anyone who sees it. "We are humbled and are sorry that we have to accept such a gift under the circumstances, but Jessica's memory will live on and the children will have many hours of enjoyment," said Homosassa Elementary Principal Regina Allegretta. The construction of the playground was funded by donations and organized by Jessica's father, Mark Lunsford. He says he hopes it's a place where kids can go and feel safe. Jessica's grandmother, Ruth Lunsford, says her granddaughter loved playgrounds and would have appreciated this one. Four playgrounds have been built in Lunsford's honor. "Oh, she would have loved it," said Lunsford. "She would have loved it. She's happy right now. She knows it's there. She's happy right now because it's there for the kids." John Couey is charged with the abduction, rape and murder of Jessica Lunsford. His trial is scheduled to begin next July. The state is seeking the death penalty. 5 years too late..

German Company Says Nein to Grumpiness Monday, November 07, 2005 You vill be happy in the office — and you von't vhine anymore at vork! After one female employee refused to smile all day at work, a German IT company banned grumpiness in an effort to promote a more congenial atmosphere, according to The Australian. The new policy requires employees at Nuzwerk (search), in the German town of Leipzig (search), to sign a contract requiring them to remain in a good mood all day at the office and leave complaints and gripes about co-workers and work conditions at home. "We made the ban on moaning and grumpiness at work official after one female employee refused to subscribe to the company's philosophy of always smiling," office manager Thomas Kuwatsch told The Australian. "She used to moan so much that other employees complained about her complaining. Once it was part of the contract, however, our employees really started to think positively," he told the paper. "Mood is an important factor in productivity and everyone here works hard and is happy," Kuwatsch told The Australian.

Three die playing catch with grenade Mon Nov 7,11:27 AM ET BANJA LUKA, Bosnia (Reuters) - A hand grenade being used instead of a ball in a game of catch exploded early on Saturday killing three youths in this Bosnian town, police and news agencies said. Two youths aged 19 and 20, one of them from neighboring Croatia, were killed instantly while a 20-year-old woman died on her way to hospital, police said. Her sister was slightly injured but two other youths suffered serious injuries. The blast occurred at 2:00 a.m. in the western town of Novi Grad at a place in the town center frequented by youngsters. Police said an inquiry was under way and declined further comment. It was not clear why the grenade exploded. ONASA news agency quoted witnesses as saying the youths tossed the hand grenade to each other before it exploded in the hands of one of them. Bosnia is awash with illegal weapons left over from the 1992-95 war and tragic incidents are frequent despite several successful campaigns by international peacekeepers and police to get people to hand over illegal weapons.

The attack followed the murder of another defense lawyer in the team who was shot the day after the trial started in Baghdad last month. Police and defense team sources said Adil al-Zubeidi was killed in the attack in western Baghdad, while Thamer Hamoud al-Khuzaie was wounded. Both men were on a team defending Saddam’s brother Barzan al-Tikriti and former vice president Taha Yassin Ramadan, legal sources said. Saddam’s main lawyer, Khalil al-Dulaimi, blamed the government for Tuesday’s attack, telling Al-Jazeera television that the shooting was carried out by “an armed group using government vehicles.” ‘The situation is unbearable’ “The aim of these organized attacks is to scare Arab and foreign lawyers,” al-Dulaimi said. “We call upon the international community, on top of them the Secretary-General of the United Nations, to send an investigative committee because the situation is unbearable.” In last month’s attack, Saadoun al-Janabi was kidnapped from his office by armed men who identified themselves as employees of the Interior Ministry. He was murdered on Oct. 20, the day after his court appearance at the start of the trial. The murder of Janabi renewed accusations of sectarian violence involving government forces. Lawyers want trial abroad Saddam and seven others are facing trial on charges of crimes against humanity but his defense lawyers, fearful for their lives, on Monday called for his trial to be moved abroad. In a statement, the defense team called for the “transfer of the place of detention of the president and his aides to another country because of grave danger to their lives”. It said the team had received no word from the court or the government guaranteeing its safety. The lawyers said it had become “impossible to continue visits to their clients” in the heavily guarded compound where Saddam and his aides are held. “The defense lawyers cannot continue their visits because of the increased threats and with the serious deterioration in violence,” the statement said. Saddam and the seven others were charged with crimes against humanity over the deaths of 148 men after a 1982 assassination attempt against the former president in the village of Dujail. Trial delayed over scared witnesses The trial has been adjourned until Nov. 28 after the judge said witnesses were too scared to testify. Human rights groups have called for the same protection for defense attorneys and witnesses as has been given to prosecutors and judges. The defense team said it would not cooperate with the court until the authorities met their demand for protection and a full independent investigation into Janabi’s murder.

And as I understand the 3 strike law, don't they have to be felonies? I'm not certain if the prescription violations are felonies. If not, a three strike law would not have put him in jail. Basically it appears as if the Judge just saw some drug addict, hooked on prescription drugs. Or how many he committed between '93 and '97 and didn't get caught for... The battery and false imprisionment in 93 and 97 should have been enough. Had it been.. this precious little girl may be alive today.
