It will also be allowed if the plaintiff allows the defendant to use the DNA testing as evidence they didn't have sex. That opens the door to question the credibility of the testing. But even if it's excluded, at this point the jury pool is tainted. I'm sure everyone in that area knows the story. That's all you need in a civil case, some kind of hook that provides a level of risk of taking the case to trial. No, we don't know what the DNA test results really are. We have some anonymous leaks. They may or may not be accurate.
  2. There is a very small probability that they set this all up--anything is possible! However, there's no actual evidence anywhere supporting that. It's all just baseless speculation, mainly from right-wing media and conservatives who, for some reason, feel the need to make the kid the bad guy and downplay the action of the authority figures in this case. It's all Alex Jones-level nonsense so far. More to the point, yeah, the school's and the police's actions pretty much do negate if this was a "setup". It wasn't a bomb hoax, he never presented himself as a threat, and he was truthful about what it was the entire time. The "setup" only works if the school and the police respond in the stupid, ham-fisted manner that they did. If they act like competent professionals, the "setup" doesn't matter and nobody ever hears about Ahmed. If the school and police's reaction were so predictably terrible that the family could concoct this plan, that in and of itself is a problem.

  8. See, the problem is that even if it was a "setup", the school and especially the police still look really bad here. The far-fetched "setup" doesn't work if they aren't so predictably terrible and incompetent.

If it's the official sealed and tagged evidence, it's what verifies that everything is still legit and controlled. If the evidence is out of its proper storage, then the chain of custody is broken and it's basically useless (remember Ryan Braun getting off on this technicality a few years ago?)   15. Regardless of the alleged DNA test results, this seems like it pretty much guarantees that Kane won't charged. The only possible physical evidence has been tampered with.

As for the results of the DNA tests, isn't that still just unconfirmed leaks?

I am 100% in favor of criminal prosecutions in addition to whatever fines are assessed.
  21. Nobody's going to claw back VW earnings I don't think, but obviously their stock is going to take a hit with or without the completely deserved fines. They're going to have to spend billions to fix their customers' cars, and they've done a lot of damage to their brand in a country where they already struggle.

We went with that over granite due to the zero maintenance and risk of staining, and we've been very happy with it for the last four years. I think the cost was about the same as a granite option.
