It all depends. Do I think someone right out of law school who had a 711 license could do a municipal division lawsuit, sure why not. Do I think that they could do a medical mal jury, probably not. Some people dont even get an attorney for many things, so they would probably be better off with a 1L than doing it on their own.
-
But isnt that really the consumers fault? You can go get one of those new attorneys for a fraction of the price. You dont need to work at a firm, it just makes the client feel safe and warm. Some of the highest paid attorneys I have worked with have been by far the worst.
-
Its just like lawyers, if they feel there are to many or the marketplace is getting saturated they increase the bar fail rate. What that doesnt solve is all of the terrible lawyers who already have licenses and get to charge jacked up prices.
-
It wont matter. Tax them a 100%, theyll increase fees 100%. Doctors have one of the most powerful and persuasive lobbies in all of America.

QUOTE (Jenksismyb**** @ Jul 5, 2012 -> 12:04 PM) What's funny is that anymore these "experts" are being ignored by juries. I was just talking to a guy the other day that lost a jury trial and while interviewing the jury they all said they knew the experts were hired guns saying the opposite things, so they didn't really take their testimony into consideration like they would a normal fact witness. Well that is why cases settle, you never know what you will get with a jury trial, so it makes more economic sense to lock in your risk. The real issue is obviously juries, but how do you fix that problem? Its not just medical mal, its in every case where a jury is involved (civil and criminal). You get odd results, but the system was created to have that, so you cant just cap awards because juries are inconsistent, otherwise you are basically saying we cant trust juries, and if that is the case shouldnt it all just be bench trials? (And even then as Im sure you know, you will get a judge who makes an odd ruling.)

QUOTE (southsider2k5 @ Jul 5, 2012 -> 12:02 PM) Thanks for all of the liberal spin, but in the rush to politicize it, you are missing the fact that this all adds to the cost of the system, which is the whole point. As earlier when you all were comparing total costs, to total costs, this all factors in. None of that is as a result of health insurance. Health insurance is a result of all of the costs. Until costs are dealt with, health insurance isn't going to get any cheaper. How are my comments about legal malpractice law in Illinois "liberal spin"?

Tuesday night fun, weds night not fun.

I thought that is what everyone is doing? Talking about how good these teams will be next year. Or are they replaying last season with new rosters?
-
The McDonalds case is also another fun one where you can really hammer someone who doesnt know the case. There are actually some really ridiculous lawsuits, the best one (imo) involves a Dr suing BMW for his car being repainted. If you actually work in law you know Dr's love to sue people (oh the hypocrisy.) The Supreme Court Case is: http://www.law.cornell.edu/supct/html/94-896.ZO.html BMW v. Gore The Doctor asked for $500,000 in his original complaint as damages.
-
I know, Im just saying there is a stronger argument. Most people just do not realize that medical mal is a very difficult case. They have the idea that you can just walk in the door and sue your doctor, which is absolutely false.
-
So OKC a young team cant get better, but the Bulls will? That makes sense.
-
Isnt your argument presupposing that these are not valid cases? Why cant it just be that there are more incidents of Dr's f***ing up worse in the US and thus resulting in more lawsuits and damages? Once again, the key question is how many of those lawsuits are without merit. The answer is, at least in Illinois, not many as you have to have an independent expert state there is a meritorious claim, which is basically the highest standard of any civil lawsuit I can think of.

QUOTE (southsider2k5 @ Jul 5, 2012 -> 10:41 AM) .I'd bet things like malpractice rates through the roof and crazy lawsuits are a pretty American phenomenon as well. One of the greatest myth's ever perpetrated on the American public. Medical Malpractice is a very difficult case. You cant just file a lawsuit against a Dr., you need to have an expert (another Dr) sign an affidavit beforehand (at least in Illinois). That is why most medical mal cases settle, because most of the time its abundantly clear that the Dr messed up. Why shouldnt you have the right to sue your Dr if he cuts off the wrong leg? Why should your damages be capped? Doctors have a very very powerful lobby, its nothing more than corporate interests beating out the little guy.
-
Yeah Shumpert got hurt, but the deal is still silly as Nash is a free agent and they are giving up something valuable just so they can sign a guy who is over 35.

This is going to be a really long year in the NBA.

You really dont see the correlation between the govt telling you what size drink you can buy and your rights being taken away?

QUOTE (RZZZA @ Jul 3, 2012 -> 04:54 PM) How are the Celtics NOT a team that found a core that works? Rondo/Allen/Pierce/Garnett is their core, they've been together for many years, enough time for chemistry to form. Chemistry is a huge part of why they're such a good team. I don't want to be like the Knicks, who destroy and rebuild their team every single year, chasing the next big FA acquisition or big name trade. Stability in an organization is very important Because half the core you mentioned was added via trade. Garnett trade: On July 31, 2007, Garnett was traded to the Boston Celtics in exchange for Al Jefferson, Ryan Gomes, Sebastian Telfair, Gerald Green, Theo Ratliff, cash considerations, Boston's 2009 first-round draft pick (top 3 protected) and the 2009 first-round pick Minnesota had traded to Boston in the Ricky Davis-Wally Szczerbiak trade of 2006. The 7-for-1 deal constitutes the largest number of players traded for a single player in league history Ray Allen- June 29, 2007 The Boston Celtics acquired guard Ray Allen from the Seattle Supersonics on Thursday night for Delonte West, Wally Szczerbiak and the rights to the 2007 NBA Draft's No. 5 overall pick -- Georgetown forward Jeff Green. Boston also gets the rights to the Sonics' 35th pick -- LSU's Glen Davis. See how they added 2 superstars in a 1 month span? The year before they added Allen and Garnett the Celtics were 24–58. The year after 66-16 and won a championship. How were they together for many years and won a championship? They were brought together in the summer and won a championship the same year. Its the exact opposite of what you want.
-
Anything can happen on any given day. That doesnt mean I want to take the side that has a 1% chance to win. The Bulls as constructed last year, were only going to beat the Heat if everything was perfect. The Heat as constructed last year, could potentially beat the Bulls even if they had an injury to 1 of the Big 3. See the difference, the Bulls need the perfect season, I believe in preparing for the worst and hoping for the best. I do not believe in hoping and preparing for the best.
-
How are the Celtics a team that found a core that worked? They traded for Garnett and Allen to add to Pierce. That is the exact opposite of what you want the Bulls to do. (edit) I think someone deleted their post.

QUOTE (Jordan4life @ Jul 3, 2012 -> 04:33 PM) Most guys would. But most guys aren't Ray Allen. $3-5 million a year just doesn't mean a whole lot for a guy of his stature. Where are you getting this insight into Ray Allen? Do you know him? Because most reports are Allen is looking at the Heat, which is a team that doesnt have a lot of money and doesnt have a lot of minutes. I know many rich people, most of them would take an extra $3mil to sit around and do nothing. Because it is about ego, and the ego is how much money they have, not whether they worked really hard for it. So I just dont know how you can be so sure.
-
Ego/pride matter, but money talks. If you can get a few mil to just sit around on the bench, most guys will take it.
-
That presumes Allen feels he can actually play a full season as a starter. He may just want to join Miami to coast for 80 games and try hard in playoffs.
-
Im refusing to work hard today, so I need to spend time doing something, and right now its arguing about a NBA season thats months away.
-
I could be wrong, I just dont like the way the Knicks were built. And Shumpert's game is athleticism, which is why a major injury could significantly impact his ability to play the game. I said that the Knicks may not be better than the aging Celtics, which was to point out that there is a pretty big chasm between the Heat and everyone else.
-
There are reports Lin wont even be back with the Knicks. I also dont love Lin like others, if you watch the film he really struggles going to his off hand and basically needs every set run on the right side of the court. Shumpert is injured, who knows what will happen with him. Melo/Amare/Chandler are all depreciating assets and Id say its remote that all 3 play a full season. Im just really not a fan of that team.
