The Democrat Thread
In this case, you're both completely incorrect. There were 2 parts of the decision, one part decided unanimously, and another part decided 5-4. The 9-0 agreement part of that decision was regarding whether back pay was an appropriate response under a certain part of the law usually used for injunctive relief. The question of whether or not these plaintiffs had enough in common to qualify for class-action status was decided on the usual 5-4 lines.

WTF are we waiting for ? Call up Viciedo !
QUOTE (BigSqwert @ Jun 21, 2011 -> 11:55 AM) Referring to who? Pierre? Why doesn't that apply to Teahen and the Elf? It does apply to Teahen. Teahen and his .197 batting average and .575 OPS have played at 3b the last 2 games. Only cost us 2 runs yesterday.

OBAMA/TRUMPCARE MEGATHREAD
QUOTE (NorthSideSox72 @ Jun 21, 2011 -> 10:27 AM) I lived in the mid-south. The primary problem isn't access to good health care, its lifestyle choices. Access to health care for lower income classes may be hidden behind the scenes, but it's far worse in the deep south than in the rest of the country. Texas of course is the worst in the country. Of course, diet and lifestyle choices play a part as well. However, simply saying "the primary problem" means I need some means to evaluate that one of those options matters more than the other...because they are both true. Furthermore...even if the primary problem is diet/nutrition, that doesn't mean they should be SOL on access to health care.

The Democrat Thread
QUOTE (Jenksismyb**** @ Jun 21, 2011 -> 11:33 AM) Huh? There's always been specific standards for class certification. And this decision created a new one based on Scalia's gut. The official standard right now, in clear, unambiguous legal terms, from the mind of Justice Scalia, is that class action qualification requires "some glue holding the alleged reasons for all those decisions together.” I'll await your official legal definition of "some glue".

Marlins interested in Ozzie Guillen (again)
QUOTE (southsider2k5 @ Jun 21, 2011 -> 10:17 AM) Why would he care if he thinks he can get a contract extension out of it? He can also get a contract extension out of winning the AL Central.

2011-2012 OFFICIAL NBA LOCKOUT thread
QUOTE (chw42 @ Jun 21, 2011 -> 10:16 AM) I doubt the Sixers make that trade. Kaman is horrible. But his contract is up this year, he's tall, he plays C, and Dalembert is a free agent.

Marlins interested in Ozzie Guillen (again)
QUOTE (WHarris1 @ Jun 21, 2011 -> 10:14 AM) Agreed with this entire statement. Ideally if we miss the playoffs both should be gone, but retaining Ozzie and firing Kenny would be absoutely atrocious. Think how many Juan Pierre's and Mark Kotsay's we'd have running around. But think of the top 5 draft picks we could get!

Marlins interested in Ozzie Guillen (again)
QUOTE (southsider2k5 @ Jun 21, 2011 -> 10:13 AM) All of the while his boss keeps publicly stating that this isn't his call, so when/if it fails the whole world knows whose fault it is. If Ozzie thinks this is a potential issue...then he should stop playing Juan Pierre!

Marlins interested in Ozzie Guillen (again)
QUOTE (southsider2k5 @ Jun 21, 2011 -> 10:03 AM) Every time the roster comes up, especially when Viciedo and Pierre come up, Kenny mentions that Dayan isn't here because he doesn't have anywhere to play, because he believes in the roster he has. You don't see the 1+1 there? But that's because Ozzie Guillen is making the decision himself!

The Democrat Thread
QUOTE (StrangeSox @ Jun 21, 2011 -> 10:02 AM) The SCOTUS rejected the giant class action Walmart sex discrimination case yesterday: http://www.scotusblog.com/2011/06/opinion-...s-two-messages/ It's worth noting more why they rejected it...they rejected it by creating a new, nebulous standard which they did not define which is required for suits to qualify for class action status. Now, for example, as long as a company keeps the decision making pushed low enough where there is no official policy, i.e. it's not official policy to discriminate against women but the company sets up a situation where it is guaranteed to happen for various reasons, class action status is impossible, and 1.5 million people have to either hire lawyers on their own or just suck it up.

QUOTE (southsider2k5 @ Jun 21, 2011 -> 10:05 AM) Until all of the coal plants start going off of the grid in the next few years... If that happens, it's because gas/solar/cleaner coal plants are coming on line to replace them. You could have said the same thing as a scare tactic any year for the past 25 years.

QUOTE (WHarris1 @ Jun 21, 2011 -> 09:59 AM) Josh Smith is atrocious. Although he was one of the Bulls best players in their series against ATL... He's another guy who ought to be a lot better than he is.

Marlins interested in Ozzie Guillen (again)
QUOTE (southsider2k5 @ Jun 21, 2011 -> 10:00 AM) Think of it this way. You know your job is potentially in danger, and the general manager keeps setting you up for the fall. The one ally you have on the team is Jerry, and now you have a team that might be interested in you. I totally think think this link was Oney based. How on Earth is KW setting Ozzie up to take a fall? By giving Ozzie the exact players he asks for and then having the org mouthpieces defend them?

WTF are we waiting for ? Call up Viciedo !
QUOTE (Milkman delivers @ Jun 21, 2011 -> 09:59 AM) I obviously have no proof of this, but I'm pretty sure Ozzie would sit Viciedo just to spite Williams if Pierre were DFA'd. I've got a feeling you're right. Although, that might put Teahen in LF more often...which would put Teahen at 3b less, which would be a good thing.

Robin Ventura...Hall of Famer??
QUOTE (PlaySumFnJurny @ Jun 21, 2011 -> 09:52 AM) Omar will make it. Thome maybe, only because his will be a "clean" 500 HRs. Unless Jim Thome gets a PED suspension before he retires, he is an absolute lock.

When buying a home....
QUOTE (iamshack @ Jun 21, 2011 -> 09:36 AM) Yeah, the distance from work is the big issue...I suppose a hybrid vehicle or small mpg vehicle would be in order... Would my utility savings save me from my fuel problem? Perhaps I could charge a Leaf from my solar panels, Balta... No, utility savings on their own wouldn't make up for the gas prices of having to drive 30+ miles to get into a city on a daily basis. Gas prices are on a much more exponential trend than utility prices and should probably stay that way for the next few decades. But yes, charging a leaf from solar panels would work if you have a less than 40 mile drive per day and you could hook into a charger.

2011 White Sox Catch-All Thread
QUOTE (southsider2k5 @ Jun 21, 2011 -> 09:24 AM) Thornton is revisionist history. People had been trying to make him the closer for a couple of years now. The vast majority of people thought that was a good move. It is nothing like the Pierre thing. And the problem with Thornton wasn't being moved to the closer's role anyway, it's that he suddenly couldn't strike anyone out.

WTF are we waiting for ? Call up Viciedo !
QUOTE (caulfield12 @ Jun 21, 2011 -> 09:25 AM) Unless KW actually had the cojones to walk in to JR's office and say "unless we bring up Viciedo and play him everyday, this team probably won't be able to compete in the second half, barring miracle recoveries from Beckham, Rios and Dunn. I don't want to trash the entire future of this organization by trading away Dayan for Jeff Conine or Craig Counsell, so it seems you have to pick one of us or the other to lead this team. I made a mistake with Juan Pierre. It worked out last season but obviously he's just not going to be able to turn it around and we need Dayan's bat to spark the offense. I already mortgaged the future by giving up Hudson and Holmberg for Jackson...you have to understand that nothing can get Ozzie and I to work together. Our egos are too big to fit in the same room. Choose wisely." In a much shorter sense...he'd have to be willing to resign. That's an intolerable place for a GM/Manager relationship to be. Too much power for the manager.

Sox "trying to get a return on investment"
QUOTE (LittleHurt05 @ Jun 21, 2011 -> 09:33 AM) Let's not forgot the Angels. They belong on the list simply for trading for Vernon Wells. He will be making $9 million more per season than Alex Rios. At some point in this thread the phrase "Worst free agent signing" was used I believe. If I tried adding in trades then someone would say "oh but we're just talking about Free Agent signings" so that the focus would remain solely on KW. That's a common game. Add in trades and you add in guys like Dan Uggla.

Konerko trade question
QUOTE (southsider2k5 @ Jun 21, 2011 -> 09:27 AM) Freeing up their contracts is probably better than any prospects you would get for Konerko. How many teams would be willing and able to take on over $25 mil a year for the next 3 years? And how many of those teams have need of a power hitting 1b?

When buying a home....
QUOTE (iamshack @ Jun 21, 2011 -> 09:24 AM) Oh it's not an hour from fuel and water...there is a town called Mt Charleston that has basic food and water you can get...and I could get most of the stuff I would need when I come into Vegas for work anyways... But yeah, I'd need to get figure out a plan for food storage if I was in a smaller space, that's for sure... If you can make it work, and 5 years down the road paying $8 a gallon for gasoline doesn't bankrupt you, then yeah, that'd be pretty darn nice. I'm just imagining how detailed my maps would be of the area after 10 years living off somewhere...

I've been told that watch use amongst the younger generation is declining rapidly on account of the fact that everyone's cell phone has an accurate clock on it.

Catch All Anything Thread
QUOTE (farmteam @ Jun 21, 2011 -> 01:53 AM) There's something really weird about this sentence. I just got a mental image of a person eating Jesus. I'm pretty sure that "a mental image of a person eating Jesus" is one of the Holy Sacraments.

When buying a home....
The real problem with that in the desert is food/water. Especially in a fuel constrained environment, you really don't want to have to drive an hour for groceries every week or two.
