That's where this example is getting really convoluted.

who cares about that scenario, it doesn't really have anything to do with Instagram's TOS. That's a problem with Starbucks' use of the pic that they could have gotten from anywhere, not with Instagram's TOS.

Or stealing a gun and shooting a teacher. Or another student. Or a teacher using the gun as an intimidation tool to keep students inline. I'm going to repost this comment again: And also note that teachers are already under-resourced, under-paid and over-taxed when it comes to their job duties, and now we're going to have them as trained armed responders as well? I am literally having difficulty processing that anyone is proposing this as a serious solution.

Magazines publish pictures of celebrities all the time. I'm failing to see why Instagram couldn't sell your pic of Tom Cruise to People or whatever.
