  1. QUOTE (Jenksismyb**** @ Mar 22, 2012 -> 08:10 AM) I'd imagine that's probably because he (1) writes a ton of opinions, especially "popular" ones, and (2) he's the most anti-judicial activism judge on the Court. His baseline rule is that Judges have no businesses making law. If a legislature passes a law, that's what society wants, and that should only be changed if it's in direct conflict with something in the Constitution. This position works 95% of the time, but some of the main areas of the law we take for granted today (privacy for example) aren't covered, so his position becomes unworkable. If you're at all interested he addresses this "problem" in his book (http://www.amazon.com/Matter-Interpretation-Antonin-Scalia/dp/0691026300). See, that is the problem. He is so staunchly against judicating from outcomes and "judicial activism," except when he isn't. The most obvious case is Bush v Gore, but iirc he had a dissent last year in the Cali prison case that explicitly reasoned from outcomes. The recent 11th amendment/fmla ruling barring residents from s uing their own state is another example of pretty blatant activism. At least the more liberal lines of judicial philosophy don't pretend to be adhering to a strict, unchanging understanding of originalism.
  2. QUOTE (NorthSideSox72 @ Mar 22, 2012 -> 07:20 AM) You are looking at "non-farm payrolls (public and private)". One of his stated goals is to reduce state government. In order to evaluate the "success" of his policies - whether you are agree with them or not - is to look at all non-public payroll numbers (including farm, by the way). If that has increased, or done better than other states, then he is "succeeding". By the way, I am not saying his ideas are good. In my view, the better picture is ALL payroll, public and private, farm and non-farm, to see the whole picture. Just saying, this is not a fair way to see how his policies are doing in terms of effectiveness. He said this would bring in tens of thousands of jobs. Instead, services are cut, pay is cut, taxes for the wealthy are cut and overall unemployment is up against a nation-wide trend of going down. If you are looking simply at ideological changes, sure, he has done that. But if you are in any way interested in the outcome of those changes, he is a huge failure. Shockingly, austerity and slashing government still didn't result in magical growth outcomes.
  3. Some interesting results of Walker's tea party policies in Wisconsin: In other words, massive failure.
  4. QUOTE (Balta1701 @ Mar 21, 2012 -> 08:50 PM) In any of the what, 16 states that have passed that law? Florida's "Stand Your Ground" is particularly god awful because it doesn't even require that you feel that your life is in danger before killing someone. So, whatever a "forcible felony" may be, you now have the legal authority to kill someone to prevent it. But that was sarcasm anyway, of course people heavily criticized these dumb laws. edit: http://www.npr.org/2012/03/20/149014228/a-...-law-in-florida
  5. Also jesus christ is Florida's "stand your ground" law terrible. Too bad nobody pointed this out repeatedly before it was passed.
  6. Wanted to post this article on this ridiculous situation by Ta-Nehisi Coates: http://www.theatlantic.com/national/archiv...killing/254776/ Nevertheless, when you read this, it's worth remembering the tale Zimmerman told the cops: This tale was broadly repeated by Zimmerman's father who claimed that his son had neither pursued nor confronted Martin. We know that this is almost certainly fiction. We have Zimmerman's on the 911 call explicitly stating that he was pursuing Martin because, "These assholes. They always get away."And we now have someone on the phone claiming a "strange man" was following Martin. Again, I don't know that Zimmerman will ever do a lick of jail time, or even see a court room. But what angers people is not simply that Zimmerman might get off, but that the Sanford police would conduct a shoddy investigation, claim it was thorough, and then claim that all who objected were compromised by prejudice: This investigation wasn't one. It was a sham, an homage to the bad old days of Southern justice. Lee should resign. Emily Bazelon has more on the actual laws in Florida, though the more I see of this, the less I think "Stand Your Ground" will save Zimmerman.

QUOTE (southsider2k5 @ Mar 20, 2012 -> 01:27 PM) Hopefully they at least leave out Vanilla Ice this time. Fair point, probably won't be any lower than that
  11. QUOTE (Tex @ Mar 21, 2012 -> 11:53 AM) How many people are employed whose job it is to provide transcripts? It is easier to prove citizenship than what grade I received for English 1401 in 1979. They are all relatively recent, but my wife has to get transcripts from five different schools.
  12. Paul ryan's "very serious" (and not at all completely bulls***) new budget would result in discretionary spending being cut around 80% by 2050. http://m.motherjones.com/kevin-drum/2012/0...rious-paul-ryan
  13. QUOTE (StrangeSox @ Mar 20, 2012 -> 07:47 PM) Exelon bought Constellation in response to Duke buying Progress, our at least that is a common thought. Sent out of town st the last minute so I couldn't vote.i have no idea what referendums there were though. To add to this, exelon now controls something like 44% of the nuclear market.
  14. QUOTE (Jenksy Cat @ Mar 21, 2012 -> 07:54 AM) From before we signed Jason Cambell? Yeah there was already a post saying the three best qbs in bears history may be on the team right now.
  15. QUOTE (farmteam @ Mar 20, 2012 -> 05:59 PM) Nah if he was becoming a Scalia fan he'd start picking which side he wanted to win and then reasoning towards that end. Zing!
  16. QUOTE (NorthSideSox72 @ Mar 20, 2012 -> 03:18 PM) There are 3-4 big alternative companies out there - Constellation was one, also Spark, IGS, others. I suspect that ComEd's buying of Constellation will probably look like a portfolio buy. It allows them to get more into the supplier market and lower their own costs, as well as diminish some of the customer loss. At worst, you end up back with ComEd, where you started. The alternative is SOURCED that way. Indirectly, I am sure that means more investment in the alternatives, but directly, it means that is where your power is coming from. If demand goes up for the alternatives, they will capitalize more supply in that area. Free market stuff. Exelon bought Constellation in response to Duke buying Progress, our at least that is a common thought. Sent out of town st the last minute so I couldn't vote.i have no idea what referendums there were though.
  17. QUOTE (mr_genius @ Mar 19, 2012 -> 10:40 PM) Some recommended reading http://www.nytimes.com/2012/03/18/magazine...nted=1&_r=1 Wow another commie screed from the nyt, shocking. Of course they would publish Das Kapital 2.0. Eta I knew his name looked familiar, I read this interview a couple of months ago. http://m.thebrowser.com/interviews/daron-a...u-on-inequality
  18. QUOTE (Steve9347 @ Mar 19, 2012 -> 08:23 PM) It was either that or not be the Sox or sim a season which makes every other team different. The Sox suck in that game and in real life. However, touche'. Oh, and it was funny. After I forced Rios for Upton, the poor D'Backs smartly waived Rios. Immediately. Video Game 1, KW 0. Lol

QUOTE (Soxbadger @ Mar 19, 2012 -> 04:48 PM) You cant have zombie movies if the main characters are smart. The simple answer is that zombies dont have brains, thus even the simplest human should be able to create a fortification to stop zombies. I mean even the simplest human would have built a moat, trench, etc. You know simple techniques that were developed to stop walking armies. Let alone more advanced techniques like putting flameable material in a trench so when a large swarm of zombies came they would fall in trench and then be lit on fire. That doesnt even get into the parts about hoarding important supplies, etc. But if you have smart humans, you dont have a zombie film. Its why Carl always runs off. At a certain point you cant write that the main adult characters are acting stupid and naive. World War Z handles this very, very well, but they're looking back from a post-zombie pandemic rebuilding society perspective so the story telling is a little different.

I know there's a board policy against it, but I feel we should all be allowed to wish for the death of Michael Bay.

QUOTE (danman31 @ Mar 19, 2012 -> 03:26 PM) I understand the concept of fiction, but this show stretches it pretty far and typically zombie movies go over the top or are intentionally campy. This show takes itself so seriously that it needs to be held to those standards. Obviously, you have to allow the premise of zombies. I'm just saying I don't really think this show does it best. Exactly. A fictional universe doesn't mean that writers can get away with anything that doesn't make sense by saying "fiction!" It still needs to be internally coherent.

  23. An interim Daniels-appointed replacement with a full special election shortly thereafter seems like it would be the best solution.
  24. Either way it's a stark refutation of the idea of Obama being some sort of big-government socialist commie, especially when paired with government employment numbers.
