QUOTE (StrangeSox @ Feb 18, 2014 -> 02:23 PM) I wonder if you would feel the same if your kid had been shot to death for no reason. I'm sure I wouldn't, but I also wouldn't be able to think rationally about the situation either.

QUOTE (StrangeSox @ Feb 18, 2014 -> 02:20 PM) But at least one juror bought that he shot and killed Jordan Davis out of self defense. OK? So in the history of trials there have never been bad jurors? If it worked, he would be a free man today.

QUOTE (bmags @ Feb 18, 2014 -> 02:02 PM) Just to reiterate what happened in this story: Man goes to gas station, girlfriend leaves the car and goes into store. Man sees car full of black teens with music blaring. Man drives up next to car and has words with teens. Teen driver initially turns down lyrics, but eventually turns it back up and words were exchanged. Man shoots gun into car full of black teens. Picks up girlfriend. Drives off. Man gets pizza, goes to motel and eats pizza. Man gets arrested. Man writes letters from prison that the reason the teen died was that he participated in thug culture. Man only gets convicted of 3 counts of attempted murder. I don't care whether the years applied to the sentence are lengthy, that you can't get convicted for murder with what happened above is infuriating. I agree with you. HOWEVA, there was SOME evidence (however strong or credible) that the guy thought the kid pulled a gun out. I don't believe it based on what I've read, I think it's totally discredited by his wife who testified that he never told her about a gun, but whatever. I'm not about to sit here and claim that based on my reading of other peoples' summaries of testimony/reaction that I know exactly what evidence was offered and how a reasonable person should have voted. This guy isn't getting out of jail anytime soon, and the murder conviction is just a technicality at this point. He may or may not get convicted with another jury, but the end result is the same - the guy is spending the rest of his life behind bars for being a dumbass criminal.

QUOTE (Balta1701 @ Feb 18, 2014 -> 01:55 PM) He wasn't convicted. He murdered a kid and wasn't convicted. He was convicted of three counts of attempted murder, meaning the jurors didn't buy that he shot those three kids out of self defense. It didn't work. As to the murder charge, it's a mistrial. It didn't work, it didn't not work. We don't know yet. They'll try again. Again though, you know all the facts. You heard all the testimony. You and Nancy Grace followed every minute of the testimony and examined every document like those jurors right?

And it really didn't work. He was still convicted of three counts of attempted murder. And the murder charge was as mistrial, not a not guilty verdict. They'll try again.

QUOTE (Balta1701 @ Feb 18, 2014 -> 01:17 PM) And it worked. "God damn laws and trials and people having different opinions! I read the internet, dammit. I know what happened that night. My opinion that he is guilty is the only acceptable conclusion!" - Balta

QUOTE (Balta1701 @ Feb 18, 2014 -> 12:54 PM) "or to prevent the commission of a forcible felony." You missed the nice, vague, catch-all at the end. It's not vague at all - it's defined: “Forcible felony” means treason; murder; manslaughter; sexual battery; carjacking; home-invasion robbery; robbery; burglary; arson; kidnapping; aggravated assault; aggravated battery; aggravated stalking; aircraft piracy; unlawful throwing, placing, or discharging of a destructive device or bomb; and any other felony which involves the use or threat of physical force or violence against any individual. Which of those applies to this scenario? And did Dunn even make this argument or are you just making this up to further the "OMG GUNS, EVERYONE DIES! narrative? I'm pretty sure he argued self-defense.

QUOTE (Balta1701 @ Feb 18, 2014 -> 12:16 PM) Hence the standard that he only reasonably needed to believe he saw a shotgun in order to justify opening fire in that direction. That's not the standard. The standard is whether Dunn reasonably believed that he had to use deadly force to prevent immediate harm/death. Seeing a gun does not automatically create a fear of immediate harm/death.

QUOTE (bmags @ Feb 17, 2014 -> 04:05 PM) Completely agree. But apparently there was a handful of jurors that would not vote him guilty. "Sure sure, he tried to kill the 3 kids, but he didn't have anything to do with the kid who ended up dead! See what I'm sayin? Perfect sense". The only thing I can think of is that the one who died was the one who had the shotgun, or appeared to have the shotgun, so it was arguable that the self defense theory applied. But the other three were sort of out of the picture and were shot just because they also happened to be in the car.

QUOTE (farmteam @ Feb 17, 2014 -> 03:38 PM) That makes sense because it's a lesser included charge. Not sure of the elements for 2nd degree attempted murder. These verdicts don't make any sense then. How can they find him guilty of attempted murder three times (implying that they didn't buy his self defense arguments and that the shootings were unjustified) but then not find him guilty of at least manslaughter when the 4th kid was shot and ends up dead?

Trayvon Martin
QUOTE (bmags @ Feb 17, 2014 -> 03:12 PM) Incorrect, Judge informed jury that they could convict him of lesser charges, including 2nd degree murder. Really? What's the point of ever charging someone for anything less than 1st degree murder then?

Of all times to quit, you're quitting when it's at its best. Which still isn't great mind you, but it's SO much better than the farm nonsense.

QUOTE (Balta1701 @ Feb 17, 2014 -> 02:02 PM) Um, as of right now...he's not a murderer according to the jury of the state of florida. Technically true, but that's only because of overzealous prosecutors.

QUOTE (Balta1701 @ Feb 17, 2014 -> 12:57 PM) Again, Jenks, he did not request an SYG hearing and instead the Judge charged the jury with the "no duty to retreat", SYG standard in the instructions to the jury, and as of now he was not convicted of murder despite murdering someone. OK? So the jury was instructed on the law. What's wrong with that? They clearly didn't believe that he was acting in self-defense or that he "had not duty to retreat" since they convicted him of 3 counts of attempted murder. And I doubt I would have convicted him of first degree murder based on what i've read. There wasn't much premeditation here. This is yet another case where Florida prosecutors went for the home run instead of the single. The law worked as it should in this case. Dude's a murderer. He didn't shoot because he thought he could get away with it. He shot because he's a murderer.

QUOTE (LittleHurt05 @ Feb 15, 2014 -> 10:11 PM) 39 points? Wow. And to think in late December I actually thought about driving down to Champaign for tonight's game. Instead I watched the Olympics at home, good call on my part. I give Groce a pass on this year, tourney bid or bust next spring. This team is the worst Illinois team in my lifetime I think. 07-08 was awful, but this. They can't make lay ups. This is a JV team.

Captain Phillips - 30 minutes too long, but still gripping. Crazy that 95% of that s*** happened as depicted. Don Jon - sucked balls. I liked how it was filmed. I liked the style. There's a story there, somewhere. But JGL did not find it.

QUOTE (KyYlE23 @ Feb 17, 2014 -> 07:44 AM) Walking dead was interesting but I was a bit disappointed Reading a lot of tweets that this weeks episode of True Detective was the best one yet RE: the walking dead, Shameless. Wow. This season has been less "fun," but I think it might be the best season yet.
