So are we starting a kickstarter campaign? Donate money to the trade X player fund? -

No its 4.9mil or nothing And this is pretty standard in negotiating. The Sox probably feel they still have leverage and thus are trying to squeeze out every last drop of value. -

Kalapse, Are you hearing that the player the Sox may trade has a last name that may start with a consonant? -
QUOTE (Jenksismyb**** @ Jul 30, 2013 -> 02:28 PM) Federal court has the same offer of judgment stuff. It's a way to "force" parties to settle by adding another layer of risk to losing. Yeah I dont really consider that loser pays. IMO "loser pays" generally refers to a court where the loser of the litigation (regardless of offer etc) pays the other court costs/attorney fees. This is more comparable to a situation to where the judge basically tells you to settle or else hell do something bad to whatever party fails to.

Okay I had to look this up because there has to be more to it, and there is. http://www.adelmanlawyers.com/law-articles...t-in-litigation http://phonl.com/fl_law/rules/frcp/frcp1442.htm Basically Zimmerman would have to make an offer to settle before the "loser pay" kicks in. (edit) And I had no clue about this so learn something new.

If the landlord broke the CRLTO they likely wont try and get money from you etc. If they messed it up bad enough you can potentially leverage it into getting 2x your security deposit. Because in court theyd be liable for the security deposit + attorney fees, and as I tell landlords, thats a good way to turn a $1k security deposit into a $5k debt.

I know some, its not my specialty, Ive done a considerable amount of evictions though (both plaintiff and defendant).

QUOTE (zenryan @ Jul 29, 2013 -> 11:07 PM) A good chance he'll win that case too. All Zimmerman has to do in a civil suit is prove evidence that he was in reasonable fear being killed or gravely injured. And if Zimmerman was to win a civil suit, the Martin family would then have to fork over money to Zimmerman. ??? Unless Florida is completely different than most jurisdictions I do not believe there is a "loser pays" law. So unless you think there is some sort of counterclaim its likely Zimmerman would merely be the defendant and the best case would be summary judgment based on the law that has been previously cited in this thread that suggests Zimmerman may not have civil liability if he was found to be using self defense.

If I could stay Chicago would be my #1. After that its not really specific order but San Fran, San Diego or LA. But my #1 by far would be Chicago.

QUOTE (Chisoxfn @ Jul 26, 2013 -> 04:31 PM) Personally, I haven't bought into Emery yet. I think he has a lot to prove still I agree with this assessment. Im trying to be positive, but I think Ive made my thoughts on this subject clear at the end of last year.

I like to believe that those who try and use rules to create unfair advantages one day lose because of those very rules they created. Karma, irony, I just always hope that the universe is as twisted as I am.

QUOTE (Jenksismyb**** @ Jul 26, 2013 -> 11:26 AM) I don't think so. Self defense is a legally recognized justification and excuse for a killing. A technicality is someone getting off because a cop forgot to tag evidence properly. Or a FedEx guy not delivering a sample within a 30 minute time period or whatever the story was with Braun. In general its admitted that Zimmerman killed Martin. The reason he got off is because "technically" what he did is allowed under the law. If that isnt a "technicality" then the word has no meaning anymore. Now if youre saying that the difference is motive, and that Zimmerman has allegedly good motives whereas Braun was a cheater, that would be a good reason for arguing that they arent comparable. Because the analogy would be if Braun was taking a supplement because he thought it would save his life, but that supplement was banned.
-
QUOTE (Jenksismyb**** @ Jul 26, 2013 -> 11:14 AM) I don't think the situations are really comparable. Zimmerman didn't get off on a technicality like Braun. Isnt self defense ultimately a "technicality". And I dont really feel sad for Zimmerman, why would I? He shot and killed someone, you live with the consequences of your actions. Id feel sad for Zimmerman if he was driving his pregnant wife to the emergency room and accidentally ran over and killed Martin while he was speeding.

QUOTE (Alpha Dog @ Jul 23, 2013 -> 04:26 PM) Did they go down faster in Illinois, the last state to get cc, compared to others? It really doesnt matter. In my opinion there is no correlation between CC and gun violence: http://www.bjs.gov/content/pub/press/fv9311pr.cfm http://en.wikipedia.org/wiki/File:Rtc2.gif If CC correlated to less gun violence, then as more states passed CC, gun violence would go down. The fact that gun violence fluctuated during a period when CC was being passed by more states (1993-2011) shows that there is no basis to suggest that CC had any direct impact on gun violence in the United States. Im sure others will argue that it does correlate. As I said, not worth the time in my day to argue about it. Its not an issue that is so beholden to me that I am going to fight against the tide. You guys think more guns on the street will equal less violence, I hope you are right. What else can I say.

QUOTE (Jenksismyb**** @ Jul 23, 2013 -> 03:57 PM) With CC laws on the books in every state, fire-arm deaths have been declining over the last ten years. http://www.cdc.gov/nchs/pressroom/FIREARM_...DEATH_RATES.pdf Not sure why you'd think it'll make things worse. Because even if there is correlation (which we dont know) it does not equal causation. For all I know fire-arm deaths would be going down faster if there was no CC. I cant speculate on that, Id have to look at every single episode of violence and see if CC had some sort of impact. But you are proving my point. At this time you are fighting an extreme uphill battle against CC. So why fight CC right now? Theres nothing to fight about a person being killed in a drive by. I think most reasonable people agree that this shouldnt be allowed. Thus its criminal activity. How do you stop criminals? Thats a far more complicated endeavor than trying to fix a law. Fixing a law can be reasonably accomplished by hundreds of people. Fixing society, well thats going to take a whole lot more manpower.

QUOTE (RockRaines @ Jul 23, 2013 -> 03:27 PM) Bigger issue: A fight ending in someone getting shot Drive by shooting where an 8 year old dies. I dont give a s*** whats going on in florida, the much larger issue for us is whats going on in our town. I dont think its about what is a "bigger" issue. I think its about "What issues can I conceivably make an impact on at this current time." Right now the tide is going towards allowing more guns on the street (Illinois just passed CC), what am I supposed to do, bang my head against the wall and hope that I can somehow break it down? There are battles and there are wars. Today what I believe in is losing the battle, so sometimes you take a step back and wait for the consequences. Maybe CC will drop the crime rate, maybe it will do everything the supporters promise. Maybe Ill be right and it will be worse. Who knows, but right now there isnt really a huge amount of support for the position, so instead of fighting about things that are seemingly losers, Id rather focus my time on something that maybe possible to change. Its not like I care anymore or less, its just simply allocating resources to accomplish goals.

For me its about the law (which from the beginning I consistently said was not very good) and hopefully preventing future incidents like this. The tragedy is, that it doesnt seem either party was a bad guy. It just seems that its "wrong place, wrong time", so the question is, how can we prevent such a tragedy? If there was no SYG, would Zimmerman have chased/followed? Those are legitimately interesting debates. 7 people dying in Chicago, thats not Zimmerman/Martin, thats bad people doing bad things. At a certain point people accept that there is x% of the population who are just going to do bad things and live with the consequences of a free society. So you fix what you can, because you cant solve everything.

QUOTE (iamshack @ Jul 23, 2013 -> 09:49 AM) My advice would be to take up a new hobby....find something relatively healthy to dive into...don't be a loser like Wite and drink your sorrows away Do you workout? Ride a bicycle? Do something to transform yourself and think about all the chicks you are going to nail that are much hotter than your ex as motivation... Yeah doing something "new" is kind of a key, because otherwise there is a tendency to think about "her" whenever you do the things you used to. Many moons ago my long term girlfriend of 4 years broke my heart. For a while it was hard not to think about her every minute, then it became every hour, until 1 day, I just didnt really think about her all that much anymore. Years later, it was probably the single best thing that she ever did. I can only speak for myself, but it wasnt easy, because it in some ways it turned my entire world upside down. You go from spending 19 hours a day for 3 years with a person, to gone. Good luck.

I dislike both. No one likes my solutions though, because people want to live in a fantasy where somehow we are going to eventually win the war on crime/drugs/poverty. Whereas the reality is that we have to accept that those things are going to happen. Its better to stop racist policies and "statistically have more crime." Freedom comes at a cost.

I dont have a real facebook. If I want to talk to you, Ill find you. If you want to talk to me, youll find me. I have no interest in reliving the glory of my youth and rehashing how badass I was in High School/College. I know, I lived it. But I just dont need there to be any way someone can attach my name to something illegal.
