2011-2012 NCAA Basketball Thread

I wish more college athletes were like Jared Sullinger regarding staying in school. http://www.foxsportsohio.com/07/06/11/Sull...amp;feedID=9467 -
QUOTE (BigSqwert @ Jul 11, 2011 -> 11:58 AM) If anything, they should have discontinued offering coffee through the drive thru. But only 700 or so out of over 10 billion orders couldnt grasp the idea that the coffee was hot. Thats way too minuscule to discontinue a practice.

Sorry for the tangent.

Starbucks serves coffee as hot or sometimes hotter than the cup that burned that woman. http://gothamist.com/2008/06/07/court_shorts_se.php Nothing has changed since then except for adding a warning to the label.

QUOTE (Soxbadger @ Jul 11, 2011 -> 11:44 AM) Rock, To further explain on the injury part. I have clients who want to have waivers for their pool, trampoline etc. I always have to tell them, that if a kid dies in their pool, I dont care how many waivers they have, they are going to get sued and there is going to be a risk that they are found liable. If the injury is severe enough people arent just going to walk away. Had this lady only suffered minor burns, my guess is that the case doesnt exist. But she suffered severe burns and was in the hospital for 8 days. McDonalds offered her $800. It was just stupid on their part. I agree they should have paid her 20k in bills. However I dont agree that the restaurant is wrong for serving a hot cup of coffee to someone who ordered a hot cup of coffee. I burned my tongue on a buffalo chicken roll yesterday because bit it too soon, 100% my fault because I should know the difference between hot and cold.

QUOTE (Soxbadger @ Jul 11, 2011 -> 11:38 AM) And the jury found McDonalds warning was neither large enough nor sufficient, seems like they changed their policy based on the ruling... As for your lawsuit getting thrown out, it would very well depend on the facts. You cant just say your theoretical case that doesnt exist would be a winner or loser, it depends on the specific facts and circumstances. Yes, they changed the warning, and have been sued many times since. I base my theoretical case on the hundreds of frivolous cases that have popped up since that have been tossed. Starbucks, Dunkin, Coffee Bean etc have all been sued since 1994's ruling. Even Hashbrowns cannot be considered idiot proof anymore. There have probably been settlements for medical bills for the hundred or so cases out of the billions and billions of cups they sell. If that isnt proof of a small population of idiotic individuals I dont know what does. http://www.patriotledger.com/news/state_ne...hot-hash-browns

QUOTE (Soxbadger @ Jul 11, 2011 -> 11:33 AM) Yep McDonalds case is actually one of the better ruled cases. McDonalds punitive damage for knowingly serving coffee that was to hot was the amount of money McDonalds made on selling coffee in 1 day. (Im pretty sure thats how they got the amount). McDonalds should have settled for her medical bills when they were given the chance, but instead they wanted to be greedy and got hammered. Its a pretty easy negligence case, McDonalds knowingly served coffee that was to hot, they had a duty to serve it at a safe standard, it was reasonably forseeable that someone would spill coffee on themselves as a result of serving the coffee to hot, the Plaintiff suffered damages. My Starbucks coffee is served at 180 degrees. 5 degrees cooler than what she burned herself with. My suit would get thrown out because there is a warning on the cup. McDonalds still serves their coffee at the same temp. Edit to respond to yours. More obvious example of common sense: Serving people hot coffe that is not immediately consumable, or knowing your coffe is hot when you receive it? Once again, every restaurant serving coffee (starbucks, Dunkin, Caribou) serve coffe at well over 170 degrees, the temperature that can cause burns in less than 10 seconds on the skin. How come 99.9% of people dont burn themselves and then sue?
-
QUOTE (G&T @ Jul 11, 2011 -> 11:20 AM) Uh...no. As I recall the facts, McDonalds had been intentionally keeping the coffee dangerously hot in order to prevent people from actually tasting their terrible coffee. There were memos that proved it. The coffee was so hot, in fact, that it completely burned her reproductive organs through her clothes. Yes, she burned herself with a hot beverage. Of course she could have not dumped it on herself. I'm sure knife manufacturers are inundated with lawsuits because their blades are too sharp. A lady in Chicago sued a vacuum cleaner company for it sucking her hair out. As for the temperature issue. Coffee is optimally brewed at around 200 degrees, the coffee she spilled was about 185 degrees. She basically received coffee that had been brewed at less than the optimum temperature. Maybe they should have let it sit longer in a pot before pouring it, or maybe the lady shouldnt have poured it all over her sweatpants by placing it between her legs instead of a cupholder.

QUOTE (Balta1701 @ Jul 11, 2011 -> 11:14 AM) Somewhere like the 700th burn case involving that beverage from that company within the decade from 1982-1992, with prior settlements out of court of up to $500k before that case? LOL, every company that has served hot coffee has been sued. Most of them were thrown out. At some point, stupid people thin themselves out of the herd. The guy riding a motorcycle at 200mph with no helmet and the guy who leans over a balcony on the 30th floor to point to a car below. You cant build a world with padded walls and safety nets for every idiot that wants to do something idiotic. 700 people burned themselves out of 10+ billion. Wow, the horror!
-
QUOTE (Balta1701 @ Jul 11, 2011 -> 09:46 AM) 100% yes. That still remains the single worst example you could possibly give in your case. One of the most frivolous lawsuits in history? One that was a flashpoint for Tort reform? Ha, its a great example. Sometimes people are just stupid.
-
QUOTE (Balta1701 @ Jul 11, 2011 -> 10:32 AM) You really believe that the fact that it's worth $10 plays into anyone's reactions here? The only reason why people wouldn't do exactly what this guy did is that they've now seen it happen. We see people leaning out over the upper deck in worse spots all the time, they just have better railings at most of those. We see people fall over fences fairly regularly. This one was just in the wrong spot. Or the reason people wont lean over a railing is because they realize they can fall. The railing was the exact height of many balconies on highrises all over Chicago. I'm betting people falling off of them is an extremely rare occurrence. If they do fall over, its simply their fault for not understanding their own balance as a human and being particularly stupid.

QUOTE (Balta1701 @ Jul 11, 2011 -> 09:05 AM) Of course, it's America, let's let the big money entity which has a stadium with a flawed design entirely off the hook. I'll give you a pass on the fear of heights thing, but I'd guarantee you I'd have done just about the same thing, and I'd bet a huge majority of baseball fans would have done the same. The ball was a little short, your brain is processing "If I don't reach for it, I miss the ball" during that split second. It's not processing the risk that fast, and it's not even realizing that its at risk until its too late. AH jeez, I bet it was McDonald's fault when that dumbass lady burned herself with hot coffee. Sometimes stupidity is at fault.

QUOTE (Jordan4life @ Jul 8, 2011 -> 01:57 PM) I imagine Greg Oden will be announcing his retirement this time next year. The C position will never be dominant again. Never know, there are some young big men coming up through the college/HS ranks. -
QUOTE (T R U @ Jul 8, 2011 -> 11:54 AM) The point is no one should have to wait, and if Dunn is just going to strike out what does it matter if you miss it? Which you wouldn't anyways.. You dont HAVE to wait, but its much more polite to others around you if you wait until the action stops. Thats how its always been in sports as a spectator, and I wish people would continue to pass that down.

QUOTE (T R U @ Jul 8, 2011 -> 11:52 AM) Hockey is a little different from a baseball game.. and yes it does give you the right.. if you have to go to the bathroom or want food or to buy something and you have to walk past people to get out, too bad.. If you pay for your ticket, you shouldn't have to worry about not being able to leave/get back to your seat.. who cares if you cant see for 1 second.. Who cares if you wait 30 seconds until Dunn strikes out and there is a break in the action?
-
QUOTE (T R U @ Jul 8, 2011 -> 11:46 AM) What? That cant be true, if you paid for your seat you should be able to come and go as you please.. Its rude and stupid for you to do this in the middle of the action. I LOVE how they limit this in hockey.

Apparently he was talking and moving as they carted him away. His son will always remember the day his dad died and he saw the cause. Awful.

walking down the aisles or making you stand up during an at-bat. You should wait for a break in the game to move from or to your seat.

Obviously I have a scarlet and gray boner for Santonio, but he's also a great receiver and runs really good routes with speed. He would be a good guy in our offense.
