Antonin Scalia passes away
I'm not saying it isn't happening, I'm saying our government has a much better process to deal with it. Whereas for senate never confirming everyone, it would basically be recess appointing everybody.

Antonin Scalia passes away
QUOTE (Jenksismyb**** @ Feb 15, 2016 -> 04:48 PM) That is a specific issue and I was being more general. In US v. Texas Obama didn't just tell Homeland Security to stop arresting illegals, he was trying to include adults in the classification that normally applied to children under a certain program. He was expanding the law, not refusing to enforce it. There was also a notice requirement that they failed to abide by, so they, arguably, violated the law. And you're right, there's a question as to whether the states even have standing to stop him. Right, but it was expanding his 2012 guidance that advised not to deport children, which was challenged by the courts and lost. What other items beside immigration is he refusing to enforce?

Antonin Scalia passes away
QUOTE (Alpha Dog @ Feb 15, 2016 -> 04:41 PM) Doesn't matter. They outright came out and said 'you don't get any more appointments'. Pure politics. That article says recess appointments.

Antonin Scalia passes away
QUOTE (Alpha Dog @ Feb 15, 2016 -> 04:30 PM) August 1960, the Democrat-controlled Senate passed a resolution, S.RES. 334, “Expressing the sense of the Senate that the president should not make recess appointments to the Supreme Court, except to prevent or end a breakdown in the administration of the Court’s business.” Each of President Eisenhower’s Supreme Court appointments had initially been a recess appointment who was later confirmed by the Senate, and the Democrats were apparently concerned that Ike would try to fill any last-minute vacancy that might arise with a recess appointment. yeah, because only one side plays politics with the courts. This crap been going on forever. https://www.washingtonpost.com/news/volokh-...s-appointments/ K we aren't talking about Recess appointments. I would not recommend Obama put a recess appointment on Supreme Court.

QUOTE (Jenksismyb**** @ Feb 15, 2016 -> 04:28 PM) Good response. You are. I don't know what else to say. Your contention that the supreme court cannot reverse the DAPA guidance of the Obama administration is false. It will be on the 2016 docket and a stay was issued last year.

Antonin Scalia passes away
QUOTE (Jenksismyb**** @ Feb 15, 2016 -> 04:13 PM) No there's not. He's choosing not to deport scores of illegal immigrants. That's his non-action. The states/congress can't force him to tell his officers to enforce those laws. No court decision is going to change that. His attempt to change rules via executive action have been challenged by the states, that's the only process in place. He can ask the courts to review the power the Senate has in the Appointment Clause if he'd like, but it's pretty cut and dry. You are wrong.

Antonin Scalia passes away
There are actually processes in place to deal with that. There is no overriding the Senate refusing the vote on hundreds of appointees. Notice that Obama's executive action on immigration went up through the courts, as did the EPA changes. So, good luck with #bothsides-ing this.

White Sox interested in SS Ian Desmond
QUOTE (ChiSoxFanMike @ Feb 15, 2016 -> 03:57 PM) So, are the "Desmond to the White Sox" rumors all but dead at this point? I haven't been following this thread as much lately. Pretty much. Last Wednesday night we got those tweets, then the Knightengale denial, then silence. One thing of note was Bucket came on and said that we were still probably going to add a bat but more likely through trade, and he wasn't sure how much of an impact bat it would be.

I don't recall anything. Maybe possibility of Cubs re-signing him? But no, no rumors.

I frankly haven't read anything at all about Sox and Jackson.

2015-2016 NBA Thread
QUOTE (Chisoxfn @ Feb 15, 2016 -> 03:27 PM) Well, given Durant's injury, I'm going to guess whatever he does, he doesn't just sign a 1 year deal. I presume he'd sign a long term deal with a potential opt out after the first year. Westbrook a year from now and no one knows whether he will stay. Real question is, if Durant leaves in FA, does that mean they move Westbrook and rebuild in the same off-season? Now you are talking, and I've had the same thought.

Would love it, but Davis just seems like a good, loyal kid. He could have played for someone else beside Prospectives, and didn't. I think he'll stick around through thick and thin.

Oh, not saying Lakers are an attractive situation but I know they will have room to offer max and will pursue hard. You are right if Clips get rid of Blake they may make offer. I think it's between OKC and WAS personally. But who knows, wouldn't be surprised if Dallas/Houston do crazy stuff to offload assets and are in mix, as they always seem to be. If I was NoLa, I'd do everything possible to shed what I can to offer max to him. That would be filthy.

USA Today 2016 season predicitions
Yeah and we only play 3 of our first 13 games at home. Granted, 3 of those are in minnesota, but the others are in Oakland and Tampa. I really like how few home games there are first 2 weeks of April. FINALLY. Good work MLB.

White Sox interested in SS Ian Desmond
I don't htink anyone is relying on his power to improve, 20-25 hrs from the SS position means we are looking at 115+ home runs from this infield.

2016 MLB Draft
Reading about Missouri baseball preview. Sounds like I should try to watch them this year. Would be interested in Reggie McClain in later rounds, Tanner Houck, obviously, and our ole Montas de oca. Most of their intriguing talent is 2017 but sounds like there's good stuff like there used to be.

Rubber stamping whomever the president picks != refusing to vote on ANY appointment from president. If you were designing a government, nobody in their right mind design anything that way. That argument is the equivelant of "we should destroy the US system of government because it allows us to". All the republicans had to do was hold up anyone actually appointed. By premptively refusing they are, again, setting a precedent that our democracy cannot function under ideological parties.

2015-2016 NBA Thread
QUOTE (southsider2k5 @ Feb 15, 2016 -> 01:52 PM) The Warriors keep getting mentioned too, but I have no idea how realistic that is. Again, out of that list, how do the Bulls win that? The answer is, they don't. Right. Especially as we appear to be rebuilding. We will have no true center. Washington - hometown LA - Durant loves limelight and media, it seems NY - no idea, but NY GS - best team in world

White Sox interested in SS Ian Desmond
QUOTE (MuckFinnesota @ Feb 15, 2016 -> 02:04 PM) Sorry if this is off the White Sox payroll discussion, but can someone point me to where the tweet was where the Sox offered Desmond 2 years at $11 million dollars? Sorry, knew that would get someone. That 2/11 is referring to the date this report came out.

We are talking about basically 2 sessions with 8 justices. Regardless of party, the confirmation tactics have gotten out of control. Senate needs to re-do their rules so appointments have to be voted on. They can even do "requires 60 threshold", but they have to be voted on.
