  14. FWIW, according to the laws of the state of Hawaii, as long as she did not pass before her absentee ballot was received and processed by the state, her vote should still be counted.

It's an interpretation of the constitution thing. But in the end, it was much to do about nothing and the senate passed a resolution declaring McCain officially eligible in case the issue arose. Notably, that resolution was introduced IIRC by the Junior Senator from Illinois.
