Thankfully, this guy wasn't killed, but it shows why even being as non-threatening as possible, laying on the ground with your hands up in the air while you calmly talk to the police, can still lead to you getting shot. Florida police shoot black man lying down with arms in air The police wanted to shoot a severely autistic man who was sitting in the street holding a toy, and his caregiver intervened. They ended up shooting him in the leg instead.

It's still a matter of how you (and he) portrayed it. He's not some wise, completely objective and impartial observer who's divined The Truth from The Evidence that the President simply cannot be guilty of obstruction of justice. It's one constitutional opinion on a matter that's never been settled by the courts or politically. Some scholars agree with him, some don't, and it isn't a reflection of partisan politics. Maybe a bunch of people are really contacting him privately telling him how smart and correct he is, maybe some are shunning him out of partisanship, but that doesn't mean his opinion on the issue is final.

There is a legitimate Constitutional debate as to whether a sitting President can be charged with any crime at all, and whether a President can obstruct justice (at least federally, I don't think the arguments would apply to obstructing state investigations). Dershowitz takes the side that no, the President can't even possibly obstruct justice as he's the head of the executive branch. That's fine, but other Constitutional scholars and lawyers disagree. It's an unresolved question. Painting it as Dershowitz choosing "evidence" while everyone else is choosing "partisan politics" is a fundamentally dishonest depiction of the debate.
