Basically, if you are not a deputized law enforcement officer and you are not inside your home, the only time you may legally fire a gun at someone or even deliberately brandish or point a gun at someone is if that individual initiates an immediate, believable, and deliberate threat to your life or the life of another innocent person. The threat must be deadly (specifically, a reasonable person in your shoes would have to believe that if the assailant were to carry through with his threat, it would likely result in death or great bodily injury to you or another innocent person). A person threatening to throw a ping-pong ball at you is not posing a deadly threat. On the other hand, someone pointing a firearm at you definitely poses a deadly threat. We should especially point out, in this context, that simple trespassing does not consitute a deadly threat. The classic hillbilly approach of brandishing a shotgun at someone who has wandered onto your property might not only land you in jail, but it could, quite possibly, entitle the trespasser to legally shoot you in self-defense. In additional to being deadly, the threat must be immediate (i.e. it has to be happening NOW). Note that an unarmed individual who verbally threatens to go fetch a gun so he can come back and shoot you is NOT posing an immediate threat. The threat must also be credible; you have to believe that your assailant has the means, the ability, and the intention to follow through with the threat. When it comes to credibility, deception intended to make you believe that your assailant is armed can count. Thus, for example, a thug who confronts you on the street with his hand placed in his coat pocket with a finger extended (so as to convincingly create the outward appearance of a concealed gun being pointed at you) and who then demands your wallet, is, in fact, creating a believable deadly threat, even though he isn't actually armed. On the other hand, if your best friend comes up to you during a backyard barbecue, slaps you on the back in a good-natured fashion, and says, ìHey, Bob, I'm gonna kick your ass for taking the last beer that was in the cooler,î he is not posing a credible deadly threat and, therefore, you are not entitled to shoot him. Furthermore, the threat must be deliberate (i.e. you should have good reason to believe that you assailant's threatening actions are intentional rather than inadvertent). If a little old lady is backing her Cadillac out of the driveway, oblivious to the toddler playing on the sidewalk directly behind her, you are not entitled to shoot her. Finally, the threat must have been initiated by your assailant in the absence of any such threat from you.

So again, non US citizens.
  3. ive had this argument with my relatives all day. at the end of the day, the law is pretty clear, you can't point a firearm at an individual (legal or illegal) unless you in immediate danger.

My question, as a business owner, do I have the ability to contact say a School District in Florida and request information pertaining to a particular contract they entered into with a competitor of mine, or do I need to actually live in the boundaries of this School District?

Here in Illinois, I can... * Own a firearm, but not a roman candle * Bet on an animal, but not on an individual * If under 18, can eat 15 Big Mac's a day, but not smoke a cigarette * If 19, go fight in a war, or even be drafted, but not drink a beer. * If 16, drive an automobile as fast as 65MPH, legally, but not buy a Playboy. it seems that I have the right to engage in very serious activities, (firearms, wars, driving, etc) while not the right to engage in less serious ones. (smoking, drinking, etc)
  18. http://www.esquire.com/the-side/richardson...lization-122308 I don't know how I feel about this... personally I'd rather see the legalization, regulation and taxation of prostitution, on-line gambling, sports gambling and here in Illinois firework sales, before marijuana. Imagine if the US government, similar to the Casino licenses here in Illinois, put up to auction 3-4 on-line gambling licenses. How many hundreds of millions or even billions of dollars would be spent to get those licenses and in addition, at a 40% tax rate (which I believe is the gambling operator profit tax rate) how much revenue that would generate and how many new "high-tech" jobs it would create.

  20. last time there were 14 pitchers and 3 catchers, etc for the USA team. the most # of AB's any USA player had was 21 The most # of innings and USA player pitched was 8.2 which was Clemens over 2 starts So the playing time is nearly equal to Spring Training where a starter will go 3 innings or so.

Dye, Thome and Konerko are not all spring chickens. The very idea of exposing them to a risk for a meaningless tournament is pointless. Toby Hall played 1st base in one game in ST. How did that work out. isnt the WBC going on at the same time as Spring Training? Maybe I'm wrong, but I thought you were just replacing an at-bat in Phoenix with an at-bat in the tournament.

It will be 7-7.50% by mid Spring. 2) lending restrictions are tighter than ever... its not just credit score. its revolving debt, debt/equity ratios, % avail, etc. I can tell you that in the past 30 days, I've had numerous customers declined for lending with personal credit scores exceeding 720. One was a plastic surgeon who was taking $350k a year out of his practice as personal income. His problem, over $250k of revolving credit card debt. No one would touch him with a ten foot pole. He was looking for $125k for a tech upgrade for the practice. Also, personal credit scores are starting to go down for no fault of your own. Banks are re-evaluating home equity lines of credit. If the bank gave you a LOC for $100k, and you've got a $35k balance, they may re-evalute, due to the loss in value of your home, and drop the line down to your current balance right away. Thus you are instantly maxed out. That kills your score too.
