Regardless of the alleged DNA test results, this seems like it pretty much guarantees that Kane won't charged. The only possible physical evidence has been tampered with.

i dont even think Law and Order would find this a plausible story. So messed up

I have no doubt this will become a Law and Order/CSI/NCIS episode in the future. It is that crazy.

So would that rape kit have been in police evidence? Which means someone went it and got it?

Am I following this right?

The ONLY way I see that changing is if this was opened by the DNA testing organization, and in the process of them disposing of the bag after testing, some idiot at the lab grabbed it for who know what reason.

In that scenario you can ensure chain of custody to that point. What happened to the bag after that point would be irrelevant.

To me that makes the most sense because apparently they have tested the rape kid for DNA if you believe the rumors, so wouldn't this specific bag have been opened at that point?

Don't know for sure, just trying to put things together.

Huh, that is a possibility. I wonder what the normal procedure is for something like that.

Well if they do get the FBI and DoJ get involved, they'll have the best investigators in the country on this. But yeah obviously the dismissal of physical evidence bodes well for Kane

I'm looking forward to some analysis that can bring clarity to this mess.

Double-edged sword for Kane. On one hand, he probably won't be charged. On the other hand, he won't be exonerated. This is still bad news for the Blackhawks.

All he shows is the paper bag. That could have easily been from after it was opened and someone took it. Doesn't the kit go straight to the lab and then to the police? This is all very strange and weird. His comments were equally strange. Placing blame on everyone else and giving up kinda.

Does anyone in the media not feel weird about this whole thing?

If there is no evidence of intercourse with Kane how exactly do they expect a grand jury to bring charges?

Now it's being reported the evidence bag was empty. I didn't see that before. So did someone dumpster dive or do they destroy those?

@RobElgasABC7: As for settlement talks between accuser and Patrick Kane, her lawyer says "I've never settled a case in my career."

He must not have tried many cases then.

Yeah, in a lot of date rape cases it's not a question of whether there even was sex/sexual contact but whether it was consensual. If Kane is denying that he even had sex with her, physical evidence is pretty important.

I have yet to see that question answered either way.

This is all crazy. So much speculation based off of the theatre, I hope eventually some details emerge that can be verified.

Patrick Kane attorney tells Trib that his client would be hurt most by tampered evidence because they can't do their own testing if needed

Patrick Kane's chaffeur that night was an off duty cop that is his buddy, right?

This is just nuts. A lot of it feels like a circus because the results didn't go the accuser's way.

That said, part of me feels like Kaner hired some asshole to bust in, steal evidence, and deliver that empty s*** to the accuser's mom's house!

This would make a great Lifetime movie assuming Kane does go away for rape.

Of course he would say that...right after he leaked the DNA test "results" to the press.

Cambria said the DNA test results were known weeks ago. It doesn't sound the actual evidence was tampered with.

It sounds like it wasn't. Kane's lawyer just put the smack down in his statement

Defense can still get it thrown out since they can't do their own independent testing now.

edit: assuming the evidence has actually been tampered with/chain of custody has been broken, who knows what's actually going on right now

I would think if Kane or his "people" had anything to do with this, they would be smart enough not to leave the baggie in the parents' door.

This is so bizarre.
