If SCOTUS gets a case where existing law (case or legislated) is not relevant or clear, they have to make a decision, which is de facto creation of law. They have no choice - they have to decide the case as it would best seem to fit into US legal system. And to do that, to interperet the spirit and core of US law when the specifics aren't there, it only makes sense to reference other common law countries to see how they handle it. The legislature could then later, legislate anything they'd like.

As you say, we have finite laws to work with, and they don't cover everything - so why on earth would you not take a look at what others have done, as a reference? Just like state courts look to other states' decisions for guidance, even though the laws of each state are slightly different. Second, I hope everyone realizes that the laws of this country, Constitution included, were guided in great part by finding the best in breed from other countries. Our laws are rooted in common law and other laws already present in other countries well before our laws existed. The US didn't invent the concept of law. So, our laws and court decisions are all influenced by foreign laws already anyway.

  6. I actually watched the game last night, seeing what Contreras had. His forkballs ended up well short of the plate a lot, but when he got the grip right, they were active and near or in the zone. His fastball wasn't at its fastest, but was close. His slider, especially from the side, was effective most of the time. I don't often say this, but, I agree with Hawk's assessment last night - I think JC is close to putting it back together after a long time off. His pitches are moving, he still has velocity, he just isn't precise yet. I think he'll get there, given another few starts.
  7. Cassel comes off the DL and is activated at Charlotte (takes Egbert's slot, who was promoted to Chicago, with the DFA of MacDougal). Made his first appearance last night, in relief: 2.1 IP, 0 H, 0 R, 1 BB, 1 K.

  17. I'm sure its been discussed, but I'm also sure they would rather that Beckham put in some significant time in them minors before going all the way to the majors. And again, let's just TRY to give Anderson a real shot here, since he's been pretty darn good since he took over as a starter. How many different "ideas" have we seen in the past week or two for CF? Wise on his return, Owens, Lillibridge, Alexei/Beckham move, etc. If in mid-May Anderson is hitting for crap, and Wise is back from the DL, then maybe it makes sense to revisit things.

Finished last year with solid results. 4th round pick in 2004, has command of at least 3 pitches and a "lively low 90's sinker" according to scout.com.
