    P90X

    Did Cardio last night after work. Made it through the workout fine, but felt pretty wiped afterwards. I have been struggling to get both enough sleep the last few nights, as well as enough calories, so I think that may have something to do with it. Rock, did you ever have an issue with your calorie intake the first month or so?

It's all a moot point with Jim signing to be a backup DH/pinch hitter, but I truly think Damon can be a tremendous asset to this team. The point remains though, if they didn't sign Thome at $2m, I think something would really have to change for them to sign anyone else at this point.

If California "legalized" marijuana, I don't believe the DEA would have any jurisdiction to make arrests for MJ that was grown and sold wholly within state borders, unless, again, the seeds or equipment used to grow it moved across the state lines in interstate commerce. Its like kidnapping; the FBI only gets involved when an abducted person is moved across state lines. Otherwise, its just a state crime investigated by local police and tried in a state criminal court. Another example is murder; its only outlawed as a federal offense where the federal government has Constitutional authority to criminalize it; i.e., assasination of a president, in the context of a hijacking, on federal propery, etc. Without that connection, its solely a matter of local law and jursidiction. This may be an accurate reading of the law, but this is not what happens in practice. The Federal Government can stretch the Commerce Clause quite a bit to show that something is affecting interstate commerce, and the SCOTUS has backed them up when challenged quite frequently. In this day and age of globalism, it is almost ALWAYS possible to show at least a tenuous link (or as the SCOTUS so often likes to say, "a slender reed") to interstate commerce, and therefore, to clear the way for their own intervention. Marijuana might be an interesting case because it is a product that could be produced and consumed locally, but all the feds would have to do is show proof of the first burnouts traveling to California across state lines to purchase marijuana for federal intervention to follow. Even under those circumstances, my guess is the government could also claim that federal law occupies the same field as the state law, and therefore, preempts the state laws. The real question would come down to whether the feds decided they wanted to try and enforce the criminalization or not.

That being said, the State of California could simply choose not to enforce state legislation regarding marijuana and force the Federal agencies such as the DEA to police the issue. My guess is the DEA would throw a fit at first and make some arrests, but then eventually cool off and realize the resources are simply no longer available to fully enforce the federal laws regarding marijuana in California.
  21. I agree with Kyle...be careful. As I said earlier, don't do something in the short term because it feels good if you know or believe it can really hurt you in the long term. You've got to be strong, my brother. That being said, people do make mistakes in judgment and do change their minds. If things continue to go how they currently are, I would damn well ask her what happened to wanting to date this douchebag? Did he turn her down? Or did she just change her mind? What happened? You have every right to ask, but don't give her the third degree about it (Did you sleep with him!?!?). Just ask her why her story has changed and then make another informed decision.

Ease into eating in a more healthy way. Subway isn't bad, if you stay fairly simple with it, and with your frame and activity level, you can eat with a bit more freedom than most people. Eventually, when you're working out like you plan, your body will let you know what it likes and what it doesn't. Listen to it.
