QUOTE(YASNY @ Dec 14, 2006 -> 08:19 AM) The people didn't elect a party they elected a person. They also elected the state legislature and the governor. Johnson had 'successful' brain surgery last night. And shouldn't there be some effort or protection that the same type of person be selected as the replacement? If they elected a Pro-Life, war hawk why should the replacement be a Pro-Choice dove? How are the voters better served?

QUOTE(kapkomet @ Dec 14, 2006 -> 07:12 AM) That's a pretty good summary. Yes it is, but allow me to toss a log on The reason to not give them a trial is the government does not trust our legal system. Pure and simple. The same system we use to put US citizens to death, can not be used to try these people. Isn't that interesting. The same people here who cheer when some US citizen is given a fair trial and sentenced to death, somehow don't trust the same system in this case. And I don't buy the "they don't have rights" argument, we offer those rights to anyone who commits a crime on American soil. If the system is robust and sound enough to use it to kill US Citizens, then why isn't it good enough for these people?

QUOTE(YASNY @ Dec 14, 2006 -> 02:24 AM) Regardless of what the law is for that state ... election, appointment, bound by party, whatever ... The state law is the important thing ... The law passed by the state legislature and signed by the governor. There is no way the feds should have a say so in who represents the people of a state. So to say that it should be bound by party ... just because it might change the balance of power in the senate ... is bunk. Unless, the state law deems it be that way. I am not saying the feds should. I am saying that the voters in a state have elected someone. The obviously want someone like that to represent them in that position and at that time. I think we can also agree that there are fundamental differences between the parties. The best chance that the voter's choice would continue is to have a member of that same party representing them. And this goes both ways, and I am speaking in a general sense. But if the voters elected a conservative Senator, how are they better served when the Governor appoints a liberal to fill his shoes, or vice versa? And of course I am not advocating a change in this situation, the law is the law. But I'd like to read a counter explaining how the voters, who elected someone with a given ideology and from a certain party, benefit when someone from the other party, and presumably a different ideology, is selected?

QUOTE(sox4lifeinPA @ Dec 14, 2006 -> 07:04 AM) it's hard to hold back my internet love for you.... but when I found out YOU were playing for the other team....LOOK OUT! plus, it'll help my chances for next years election. I am working on my Reaganesque hard of hearing routine. The conservatives love that.

Follow up article Linked So Swift is busy cleaning house, the government (ICE program) tells them to stop, then a month later conducts a raid? The laws and the government agencies are really f***ed up in all this.

QUOTE(YASNY @ Dec 13, 2006 -> 10:55 PM) Check your atlas. Toronto is located north of the border. It must suck to be geographically challenged. I think it was a weak attempt at Candians humor.

One of the salespeople that worked for me bought three consecutive cars from the major rental places. She felt the strict maintenance schedules kept out weighed the "screw it it's a rental car". Plus she was usually getting higher end luxury cars and those drivers tended to be older and less likely to abuse a car.

QUOTE(NUKE @ Dec 13, 2006 -> 07:23 PM) More like a devastating body blow to those who feel that coddling terrorists and bending over back asswards for people who want to kill us will somehow make them be nice to us. I didn't realize they had been found guilty of terrorism. For some reason I thought that had not been determined, that they had been arrested, but not tried. I take back what I said. Since innocent until proven guilty is a cornerstone of our judicial system, and we are trying to show the world a better way, I can't believe we would just lock them up without finding them guilty in a fair trial. I feel better now knowing they are indeed guilty of being a terrorist. It would have been so hypocritical of us to just lock someone up without any trial. That would seem more like something Hussein would have done in Iraq, and probably torture them as well. Thank God we're a better country than that.

QUOTE(mr_genius @ Dec 13, 2006 -> 06:50 PM) definately. The company was knowingly enganging in illegal practices. at the very least the should face substantial fines. i don't buy this "well, i didn't know 40% of my employees were illegal" bs. The company was working with the government in a pilot program. The company has employees that provided social security cards. The company had no way of knowing those numbers were being used by others as well. The government knew the numbers were being used in multiple locations but will not tell the employer. The government will not tell them there is a problem. The one entity that knows immediately (IRS/Social Security) there is a problem with the numbers will not tell anyone. How can you then blame the employer? Now you think that they should be fined by the same government that wouldn't provide the information that would have allowed them to fire the person immediately? Again I ask. What is your company doing to prevent this besides the same minimum requirements that Swift appeared to have followed? What did your company do to prove that that really is your social security card? The law requires providing a couple forms of ID. If someone forges these documents, and the documents are good forgeries, how can you blame the company for falling victim? If someone hands you a forged $20 bill, should you be fined as well?

We tell the world to look to us for justice and a shining example of rights of individuals, etc. Somehow I feel we are being hypocrites when we don't live up to that.

QUOTE(sox4lifeinPA @ Dec 13, 2006 -> 06:08 PM) So Tex, I guess you're cool with one of these illegals using your SS# to get a meat packing job? No, but if a 45 year old 6'1" white guy that looks like me uses it to get a job, I won't blame the company that hired him.

QUOTE(sox4lifeinPA @ Dec 13, 2006 -> 06:05 PM) they'll be 4 brackets of 8.... I'll need help with genres but I imagine that Pop, Rock, Folk/Country would amongst the 4. thoughts? where would you put Amy Grant and Koko Taylor? Etta James? Bessie Smith? Janis Joplin? Oops and you really need to include Denyce Graves. Geek alert I know, but if you ever hear her as Carmen, it is like heaven opened the gates. She is beautiful and an incredible talent. But it's opera and no one here really enjoys the craft.

Yet a muscle bond first baseman who tears a bicep around the same time is viewed as clean as a whistle around here. But then, he's "our guy". And I am not accusing him, just pointing out that judgments get clouded by the color of a guy's uniform.

Wow Boras' supernatural powers don't work in Japan. Must just be stupid American GMs. Yet, many will still blame Boras when some GM makes an incredibly stupid decision on one of his players.

QUOTE(NorthSideSox72 @ Dec 13, 2006 -> 04:53 PM) It makes sense because that Senator is a representative of South Dakota first, and his party second. And the Governor is the highest representative of the state. So, despite that it may cause a stir in the Senate, I happen to agree with the policy. So the Governor picks someone from the same party as the person being replaced. I am certain there are great Dems and Reps in every state. Then the odds are better the replacement would have closer views than someone from the other party. And the will of the people should trump.

QUOTE(NUKE @ Dec 13, 2006 -> 04:45 PM) Well if that is in fact true then I see your point. Guess we'll leave it up to the investigators to find out exactly what happened there. The law prevents employers (and consumers) from being notified if the social is being used in multiple places. I am trying to figure out who this benefits besides the identity thief. If the employee provided the legally required documents, and they weren't cut out of a cracker jack box, I have a hard time accessing a $65,000,000 fine. Or $65,000 for that matter. There are a lot of issues here and no easy solutions, but one step is the IRS and Social Security to start monitoring these things and catching them before ten years has gone by. (article 2) QUOTE(Soxy @ Dec 13, 2006 -> 05:02 PM) And then we would all turn gay! When Johnny comes marching home!

Are you trying to limit the genre? Comparing anything from the Pretenders with Karen Carpenter or Lena Horn (BTW you are including Koko Taylor aren't you?) just seems wrong.
-
yeah, yeah, of course we are concerned for his health, now let's talk politics. When this comes up, and it goes either way, it seems that the replacement should be from the same party. It has never made sense to me the fairness of a Dem picking a Dem to replace a GOP and vice versa.

QUOTE(NUKE @ Dec 13, 2006 -> 03:54 PM) Come on Tex. 40% of the workforce?! I could see if it was a few people but something really stinks about that place and it aint the carcasses laying around outside the freezer. And if it is proven they knowningly hired people with false papers I can see the fine. But if they were in a pilot program from the government and the government won't even tell them if the social security number is being used at another employer, how can the *same government* then fine them? Come on let's change the laws and help businesses. The IRS and Social Security knew that these numbers were being used multiple times but doesn't notify the employers, now you want the government to fine them millions of dollars??
-
QUOTE(sox4lifeinPA @ Dec 13, 2006 -> 03:29 PM) it depends on the situation, they can be. Sorry to burst your arguement. Again, what should Swift have done to avoid this? What is your company doing to make certain they don't fall victim? We ask for social security cards and driver's license or passport. If someone is proven to be using forged documents, should the employer be fined?
-
QUOTE(NUKE @ Dec 13, 2006 -> 03:14 PM) I think you're absolutely right. Deport the illegal workers back where they came from and fine the living daylights out of whoever hired them. If we're going to dry up the jobs that these people are getting we have to fix it so that the cost in fines makes it unprofitable for them to go after cheap illegal labor. As it stands now that is not the case. Swift was in a pilot government program to prevent this. People stole identities and produced social security numbers. What else should Swift have done?
