  1. I doubt very much in the age of modern medicine any of these guys will nominate new US SC justices. But if that happened I would want a president who is more likely to nominate a judge that will respect the majority of Americans then one who will place his own ideology above all else. In that respect we now have a 40 yr history of the harm liberal activist judges can do with respect to democracy. I also would like to see people nominated who believe as I do that the time has come to remove the life terms associated with judgeships around the nation. As a nation that continues to evolve in the mold of science & technology we should be moving closer to real democracy. The life terms of judges plays against that.

I'll make this simple for the MAGGLIO lovefest on this board: Please explain in terms of wins why O-E-O (I can't wait until that stupid chant is gawn!) is worth 20-25% of the SOX annual payroll over the next 5 yrs. After you make that attempt I will be more than happy to gun it down to smithereens. He is the most over-rated 30/300/100 in the modern game & at best deserves no more than 9 mil a yr.
  3. SAYONARA LOSER!!! I'm so sick of the Magglio fanatics in this town. I can't wait until he's gawn! He is the most over-rated 30/300/100 player in the game today. The bulk of his rbi's come in blowouts. So his stats get padded. Just like Sosa's in the month of June when he hammers 20 HR. The simple fact of the matter is that at Magglio's age he is far less likely to repeat 30/300/100 then he is to surpass those numbers. Which makes his value far less than 14 mil /yr. Look at his performance in 2004. I'd say it rates at best 6 mil. The future of this team is Carlos Lee as far as position players go. I've been saying this for yrs. The SOX have never had a problem signing Carlos & it still remains more likely that he will get better than worse. If I'm the SOX after I deal Magglio for a solid arm to win the division I turn around & give Lee a 3 yr extension. That would be a great in your face to the loser who thinks there are more greener pastuers else where. If that be Wrigley then so be it. How many games have SOX won with Magglio's inconsistent production month to month? That's the bottom line. Why the F would any team sign a player who's not even in the top 10 in the AL to 14 mil/yr? He's luck to finish in the top 20 in 2004. This is another fine example of greed. Buehrle was greedy & it back-fired on him. The same will happen to Maggs.
  4. Judges that are allowed to rule on the constitutionality of a law are an antiquated & useless part of the system. No one can argue that kind of power promotes democracy. No one can argue that kind of power is needed in a country where there will soon be more legal professionals than engineering ones. So the opposition took the next step in the battle: declaring a boycott. It's pitting those who routinely spend $ in VA or on VA goods & services against those living in VA. That's the way the modern system should work. Representative of the people by voting either with their $ or their voice. Of course the biggest name in VA is America Online so this boycott will also serve as an indicator of how strong the opposition is. Personally I think it's sad that the concept & nature of civil unions has to fall victim to the show-boating between the two sides. Civil unions should have a much bigger scope than just the state recognizing a sexual union. It should provide for non sexual relationships as well. If they had gone that route they undoubtedly would have gotten far fewer headlines from the press.
  5. The vote doesn't surprise me at all. SOXTALK has proven time & again to slant to the left. It's sort of like the debate of the cub media bias. There are 5 cub fans for every 3 sox fans in Chicago, yet the Cubs get an 8 to 3 space differential in the paper daily. But of course there's no cub bias.
  6. Your argument is simply too simplisitic with respect to judges. If you were to add up in $'s the process of what it takes to bring a bill into law & then to enforce that law it is simply too much an amount to expect Cogress to pursue that process over & over again to where a law is deemed acceptable to an judge. Sometimes idealism has to give way to reality. Try naming the number of times a law that was struck down by a judge has been re-worked & re-introduced. It's few & far between. Congress has too many problems to deal with on a daily basis to keep re-working the same problem over & over just so it can be approved by an obviously biased judge. Interracial marriage is inextricably tied to race & civil rights legislation with respect to race. It wasn't going to become accepted in American society until blacks were. The speed at which it became acceptable after the civil rights movement is a clear indication that it was never viewed as immoral beyond racism itself. In other words you couldn't very well be a defender of civil rights & then make claim that interracial marriage was immoral. Gay marriage has nothing to do with civil rights legislation. Gays are not discriminated against because of their race or ethnicity but rather their behavior. Americans have the right to exclude groups because of their behavior. No judge has a right to define what is & is not moral in American society. The people define that themselves. The law is supposed to reflect that definition. The best way to look at gay marriage is from the perspective of married persons. They represent a social group of society defined by one man & one woman. It's up to that social group to decide whether to exclude or include others & not a judge. What would be discrimination or injustice is if one social group prevented the creation of another. So far I don't seen any evidence of that being the case. Ladies night is another perfect example of judges having no root in common sense & reality. A select few individuals are making this an issue. The overwhelming majority of Americans support ladies night. This is not an example of GROSS misuse of capitalistic use of sex discrimination with respect to pricing. This is a minor greviance. It doesn't require making ladies night illegal. It's a prime example where some are trying to use the Constitution like Bible fundamentalists to dictate behavioral policy against the will of the majority in America. That's simply abuse of judicial power to social engineer Americans against their will. In my opinion it's so non-democratic it borders on treason.
  7. On social side there are consequences to every decision a judge makes. I don't live in your fantasy world where you believe judges are anything more than idealists enacting their beliefs on a nation. You call it upholding the Constitution I call it bending the Constitution. Any one who has studied law knows that there are 2 sides to any argument & in more cases than not both sides have the same merit. So in reality there is no wrong or right way to interpret the Constitution. Likewise this is 2004 & not 1776. By & large Congress represents those who are both educated & experienced in the law. In some cases the representatives are more talented in the law than the judges. When you add to the fact that there are four times as many lawyers available to the public than doctors the % of the populus educated in the law is far & beyond anything the founders imagined. There is simply no rationale basis for judges to serve beyond the terms of the elected officials who appointed them. America is becoming more and more a collective determined by majority opinion. It's closer to resembling democracy than at any greater time in it's history. It's only the antiquated arrogant & pretty much useless judges that stand in the way. There's really no value in debating beer's libertarian views of government because they are pure fantasy to the size & scope of govt we have today. You can't turn back the clock no matter how much he wants to. You have to work w/in the system we have today. Marriage laws & regulations exist throughout the land at both fed & state levels. Interstate commerce is affected by them. So the state & fed have a say. There is no social issue in America today that does not have economic consequences. This includes abortion. By & large Americans believe gay marriage to be immoral. This is the number one reason. More than double that of any other reason. We have seen already that the issue has begun splitting protestant churches because America simply is not going to allow the courts to assimilate it's culture embredded in religion & morality. Whether you or I or any one else likes it or not by & large Americans view sodomy & lesbianism as immoral behavior. It's their right to do so & it's their right to exclude people on the basis of their behaviors. To me that's the central issue here & it's a big one. It's not just about gay marriage either. It's about language, course study, schools, work, entertainment, etc. The Constitution & Bill of Rights implied a distinct distaste for discimination on the basis of physicial attributes such as race or ethniciity. But it did not imply such distaste for discrimination on the basis of behavior. It assumed that the majority will would define a collective theme for what appropriate behavior was. That is why we have laws governing behavior. What activists judges have done over the years has served to undermine that collective by imposing individualistic will on the majority. The majority has the right to govern individual behavior in so much as it affects the majority. Activists judges have no right to undermine that. Congress & the Executive branch are supposed to influence the majority. Not judges. In terms of beers basic belief that Americans have a right to segregate themselves economicallly through ordinances, state laws, etc. in a true democracy it's hard to argue against that. What the activist judges choose to ignore is that their job is primarily to protect Americans from gross misuse of such processes. Not minor but gross. As beer suggests if a township chooses to pass an ordinace that excludes persons of certain behavior from being members that person has the choice not to live in that township. A judge should not force his existence on the majority of that township. Basically a judge should be applying common sense. If a couple of such ordinances affect only a few individuals that hardly constitutes a gross infraction of individual rights. In that respect the judge should simply refuse to rule or provide a temporary ruling on the basis of it being a minor inconvenience to the individual. That's called applying common sense. Something these activist judges seem to be completely void of.
  8. I must respond to this & bookmark this thread in the culture war thread because beer's comments strike the new front lines on this war. There are two facets to this war: economic & social. Inevitably in all capitalistic societies the two clash. America is no different. Basically he's an advocate for repealing civil rights legislation that favors a special interest group. That's what all of his points sum to. Likewise is an ardent free trade advocate that does not believe collective bargaining or human rights plays a role in scaling economies. By and large he represents a traditional conservative. If it ain't broke don't fix it. It ain't broke if the majority thinks it's working. I think beer represents a sig that is fastly fading. He's definitely a representative of the far right with views like that. On the issue of free trade it has inevitably reached the point where America first clashes with the conservative viewpoint. What Bush did for the steel industry helped to bolster the US economy during tough times. It only became bad policy when foreigners threatened to wage a trade war. Bush being an advocate of global trade inevitably backs down. But the truth is there is no economic data that suggests America needs Europe, China, or even Japan to support it's economy. In fact all facets of economic data suggests that America can effectively raised the standard of living in the W Hemisphere if it simply concentrated on trade in that part of the world. Why? Because there is both democracy, population, & lower cost labor supply to both grow human rights & economies. As big as China's GDP is, how much of it translates into a common man's wealth? The real wealth in China lies in politicians from the communist party & American, European, & Japanese capitalists that take advantage of the cheap/slave labor. In reality it is no different than the practice of corp yesteryear using scabs to break union strikes. I think the bulk of Americans from the conservative & liberal camps are becoming disenchanting with global free trade. The latest polling data outside of Americans in the W Hem indicates less than 20% are happy with democracy. If we continue to ignore our brethren in this part of the world we may be facing a much greater national security threat if they should become so disenchanted with democracy as to give it up. And there lies the biggest fault in the far right free trade ideal. Economics is as important an area of national security as defense is. Why would any intelligent nation leave economics to be driven solely by the most greediest capitalists the world has ever seen? The best policy is to pressure China on human rights by providing incentives to American corps to shift manufacturing from China to Canada, Mexico, & S America. The reality of what America is, is that it is the largest market for goods & services on this planet. It's market is better than 3 times that of any other nations. In fact all the G6 combined barely match America's. That means America controls the bulk of demand for goods & services. That's tremendous power in a capitalist world. Markets are not created overnight. To build demand you must have a spread of wealth to build consumers. Cheap/slave labor is going to make that process slow & arduous. So China might be the biggest market in the future in terms of pop but it's a long way to being the biggest in demand. The American govt owes it to the American people & those of the W Hem to use her trump card to the best of her ability. That means leveraging demand to effect supply of goods & services. This does not go against basic economic theory as the far right contend. It actually supports it. As does it support real free trade. If you are a corporation looking to buy goods the larger your order the greater your leverage towards price. The American people have the same right to apply that kind of leverage to the greed driven capitalists of the world. Meet our price & our conditions or we will go elsewhere for a new supplier. That's the way free trade is supposed to work. What has happened in America is the suppliers are no long American in nature. They are globalists & they use the American politicians like puppets to weaken America's collective power.
  9. BOTCH BOY & Ozzie's misuse of the pen really has me pissed .. so venting my anger. In the year 2004 the President can't take a crap w/out a poll or survey being done on what color it was! That's modern day America. The majority speaks thru polls & surveys & research data anonymously. In this day & age everyone is represented & everyone is heard. Today polls are conducted on sizes of 1000-2000. In the near future they'll probably double the size in an effort to reduce the error to lower than a few points. That's the future of America & with that kind of majority opinion expressed daily there's no room for activist judges ram-roding their ideals down America's throats. Is it any wonder that Asian-Americans are beginning to dominate Americas colleges? Did you not see the Berkeley report? While the mainstream media was fixated on blacks dropping from 500+ to 200+ in 7 yrs they seemed to neglect that Asian Americans had grown from 2700 to 3600. They are now the majority in the freshman class at Berk. Whites grew from 2700 to 2900. I did a little searching & I found similar trends at Geo Tech, Golgate, UofI, & several others. In fact at every highly competitive school I looked at asians were within 5-10% of the majority after experiencing double digit growth over the last 10 yrs. Pretty remarkable for a demographic that is somewhere betw 10-18%. That means is twice as likely for an asian kid to make it into a highly competitive school than any other ethnic group. Now why is that? Could it be that asian Americans homeschool/private school more than any other group? Could it be that asian Americans are more likely to use tutors than any other group? Could it be that they are the most stringent traditionally in raising their children? Could it be that they are least affected by outside media sources because of a traditional moral upbringing at home? Could it be that they realize the importance of English & instead of b****ing about they just go to work to master it? Certainly makes you wonder. Follow this trend 10-20 yrs down the road & it means the majority of highly educated persons in this country will fit this demo. I for one am ready to salute these future leaders of America.
  10. In general social engineering is when the government changes the law to accomodate a special interest group. The greater the majority rejects that change the greater the injustice to the majority becomes. Democracy is all about numbers. You have certain inalienable rights to due process to insure that your side can be heard either it be in a public forum or a court of law. You have certain inalienable rights to seek a living & pursue happiness in America. But those rights are no greater than the majority's right to do the same. Basically it's as simple as this: what's good for the majority is good for you. If you don't like it, get the F out. There's no end to the demand for entry/citizenship into America so there's no need for this country to cater to your personal philosophy of life any more. Whatever you want to do in the privacy of your own home is up to you, but you have no right to try & force acceptance of it on the majority. Our founding fathers were nieve in believing that all judges would be compelled by their education & experience to be fair & impartial to all issues. They believed that judges would somehow stand above politics because of their chosen profession. That's why they defined appointments in terms of life terms. It's clear now that they were seriously wrong. It's time we review the appointments so that when the elected official gets voted out the judge goes with him. You either believe in democracy or you don't. If you don't like it & need an elitist form of govt Europe is waiting to hear from you.

The reason why there are an ever-increasing numbers of person who are getting angry over this crap is because we don't fall into the jackass or elephant mold any more. I'm not an E cons any more. It doesn't F'g work in a global economy. Anybody with a brain knows this. Some of us want real distribution of wealth. We pay enough in taxes to where it should be doable.

  21. I don't think you realize the gravity of the situation. If they take out one of the major refinery locations the USA is SOL when it comes to gasoline. No one can help us. We will drown in our own tears because we only have two major centers to feed the whole nation. If I'm Bin Laden & I've just learned this is the case that's my number one target. The US stockpile, the Saudi's, etc. can't help. If he can knock out 1 major refinery center the US will have 1/2 the supply to meet it's demand for gasoline. Why would any other nation use their refinery capacity to help us out? Who would risk shipping gasoline in an oil tanker?

If you're a terrorist & you're looking to criple America where will you attack? Oil refineries. Why? The hardest to protect from suicide bombers. The easiest to attack near border regions. Prime target: Gulf of Mexico. From Galveston, TX to Vermillion Bay. On a conspiracy level, Exxon might aid you in your cause so they can charge $5 a gal.

Thomas Balhoff, the attorney for Delta Tau Delta, argued that the suicide note should be considered as hearsay because he does not have the opportunity to put Garza in front of a jury and have that jury decide whether she is telling the truth. He's wrong. If need be I can show him prior case precedents where notes of such nature were used to convey general disposition of victims. He has the opportunity to put medical professionals on the stand to use expert opinion to discredit the value of the note. I do not feel that classifying the note as a "suicide" note diminishes the value of those precedents.

  25. I've said it before & I'll say it again: civil unions. It's an answer that shows tolerance & equal rights without having to force acceptance. As an added bonus we can now start collecting data on them. On a bigger scale social liberalism is out of control! I saw on MSNBC that there's a legal movement out there trying to ban ladies night on the basis of it being sexual discrimination. Yep it's unconstitutional for bar owners to have ladies night in an effort to attract more customers. There is no area of our society that is free from social liberalism. Doesn't matter whether your a God-loving believer or not. The liberals are using the literal context of the US Constitution as if it were the Bible. I'm pretty confident in my assessment of the founders of the US Cons that they intended it to be a framework for democracy & not a Bible to rule over democracy. I'm pretty sure the majority of Americans don't have a problem with ladies night. Why don't these liberal activists save us all a lot of time & money & build us devices so that any action we intend to take can be put through the US Cons litmus test? It's a F'g joke is what it is!
