  2. Update from Yahoo....... No charges for Limbaugh over Viagra WEST PALM BEACH, Fla. - Rush Limbaugh will not face charges in Palm Beach County for the bottle of Viagra found in his luggage that was prescribed in his psychologist's name, prosecutors said Wednesday Charges could have nullified the conservative radio host's plea agreement in a "doctor shopping" case. Limbaugh, 55, was detained for more than three hours at Palm Beach International Airport on June 26 after he returned on his private plane from a vacation in the Dominican Republic. The state attorney's office said the medication was prescribed by Limbaugh's cardiologist, Dr. Steven Schnur, to Limbaugh's psychologist and addiction counselor, Steve Strumwasser. Strumwasser then provided the Viagra to Limbaugh, said state attorney spokesman Mike Edmondson. Strumwasser told authorities he "agreed to have his name on the label in an effort to avoid potentially embarrassing publicity for the suspect," according to the state attorney's office filing. "Thus, the medication contained in the subject pill bottle was legitimately prescribed to the suspect by his physician." It is generally not illegal under Florida law for a physician to prescribe medication in a third party's name if all parties are aware and the doctor documents it correctly, Edmondson said. However, since the doctor wrote the prescription in Miami-Dade County, the case was forwarded to prosecutors there for review. The Miami-Dade state attorney's office had no immediate comment. "There are statutes that would criminalize a fraudulent filing of a prescription," Edmondson said. The Palm Beach County state attorney's office also said it forwarded the matter to the state Department of Professional Regulation and the Department of Health to determine whether the doctor breached ethics. Calls seeking comment from Strumwasser and Schnur were not immediately returned Wednesday. "Based on the sworn facts presented by the investigating officer as well as the suspect, the elements of the offense cannot be proven beyond a reasonable doubt," Paul Zacks, Palm Beach County assistant state attorney, wrote in the filing. Limbaugh said on his radio show Wednesday that prosecutors declined to file charges because "there were no laws broken." Black's office referred questions Wednesday to Limbaugh spokesman Tony Knight. Knight declined to comment. Charges in the Viagra case could have nullified a deal Limbaugh reached with prosecutors last month in which a single "doctor shopping" charge was deferred for 18 months, so long as Limbaugh does not get arrested for any reason. Authorities had accused Limbaugh of illegally deceiving multiple doctors to get overlapping painkiller prescriptions. Limbaugh denied the charges but acknowledged he was addicted to painkillers.
  3. Loren, 71 years young, poses for Pirelli in nothing but her earrings Wed Jul 5, 11:29 AM ET ROME (AFP) - Veteran sex symbol Sofia Loren, first featured on magazine covers half a century ago, will appear for next year's Pirelli calendar dressed up only in diamond earrings. The voluptuous Italian screen legend, who will celebrate her 72nd birthday on September 20, joins a galaxy of international female stars posing in the nude for the 2007 cult calendar, the Italian magazine Gente (People) reported Wednesday. The calendar portraits of Loren taken by Dutch photographers Inez van Lamsweerde and Winoodh Matadin are "very beautiful and will add to the myth of La Loren," said Loren's close friend Silvia Damiani, one of the privileged few to have already caught a glimpse of the latest Loren revelations. Among the Naples star's screen triumphs was an appearance in a transparent negligee in her 1964 movie "Marriage Italian Style," and her striptease in front of fellow Italian Marcello Mastroianni in "Yesterday, Today and Tomorrow," reprised 30 years later in director Robert Altman's "Pret a Porter" (Ready to Wear). Her Indian summer in the nude has divided Italy's showbusiness world. "Sofia Loren is an icon, she can do whatever she likes," said statuesque actress Valeria Marini, herself a veteran of the nude photography front. But screen director Gianni Boncompagni thought otherwise. "I don't see the use of it," he was quoted as saying. And Sofia herself? "You have to be firm about it when you make up your mind to do something you like and you've been thinking about doing for a long time," she told Gente, which reports that Loren has just a completed a health cure. Born Sofia Scicolone on September 20, 1934, she and her single mother lived in abject poverty in the war-torn slums of Naples. At 14 she began entering area beauty contests, later becoming a model and appearing in a number of uncredited bit parts in films. After winning a beauty contest in Rome, she was signed to a film contract by producer Carlo Ponti, whom she later married. :puke

  9. How sad :headshake :headshake Some people just don't know when to say when. After slamming his van into a 62-year-old man early yesterday, Antonio Rosas greeted cops by finishing his can of Coors Light, authorities said. Rosas, 33, had a .272 blood alcohol level - more than three times the legal limit - when he hit Edgardo Pizarro at 1 a.m. on Roosevelt Ave. in Corona, Queens, sending him flying over his Chevrolet van. "The nerve of this guy, I would have just smacked that beer out of his hand," said Pizzaro's daughter, Audra Cabarcas. Pizzaro, a Manhattan doorman who retired 10 years ago to care for his elderly mother, was taken to Elmhurst Hospital Center with a fractured back, pelvis, forearm and severe head injuries. "My dad said he didn't see him coming.... He just crossed the street and all he remembers is a boom and he was on the floor," said Cabarcas. "How could he [Rosas] even do that? Unbelievable." Cops saw Rosas weaving over a double yellow line just before he hit Pizzaro. Rosas was pulled over minutes later, law enforcement sources said. After downing his beer, he was asked for a driver's license but didn't have one, prosecutors said. He also stunk of alcohol, had bloodshot eyes and slurred speech, and was unsteady on his feet. Rosas, a construction worker, is facing up to 25 years if convicted of drunken driving and numerous other charges.

  12. Matt LaChappa hasn't thrown a pitch professionally in 10 years. He is confined to a wheelchair, and constrained by the physical fallout from back-to-back heart attacks. Yet the Padres continue to pay him as if he were an active player. It might be the noblest thing they do. “When he became a six-year free agent, I just renewed him for six more years,” said Priscilla Oppenheimer, the Padres' director of minor league operations. “Nobody's said that I shouldn't, so I keep doing it. To me, it was the right thing to do. If they gave me any static about it, I would have taken it.” The baseball salary LaChappa draws is relatively insignificant – even by the Friars' modest standards – but the gesture is absolutely grand. It helps the disabled pitcher retain his insurance coverage and fulfills a promise Oppenheimer made when the Padres picked the El Capitan lefty with their No. 2 selection in the 1993 June draft. “When he was drafted and he came into the office to sign, I've never seen such a troop of tribal people,” Oppenheimer said. “I think he was the first full-blooded American Indian ever drafted.” Oppenheimer assured LaChappa's parents then that they needn't worry about their teenage son because, “I'll take care of him.” Three years later, when LaChappa was stricken in the bullpen in Rancho Cucamonga, Oppenheimer proved even better than her word. Narrowly interpreting a vague promise by then-CEO Larry Lucchino that LaChappa would “always be a Padre,” Oppenheimer kept the young player on the club payroll and placed pictures of him on her desk. “He's my hero,” she said yesterday. “He was always up. He had a good personality, a good sense of humor. He was cheerful. It made you feel good to be around him. “I try to go out to see him every month. Even though I do most of the talking, he's very strong in his upper body. If you get a chance to give him a hug, be prepared to fight for breath.” LaChappa turns 31 on Thursday. Friday, the seventh annual Matt LaChappa Golf Tournament will be staged at Barona Creek Golf Club to raise scholarship money for college-bound San Diego athletes. To date, roughly 120 students have received grants totaling close to a quarter of a million dollars. For Matt LaChappa, charity has become a two-way street. “When Matt was in high school and going to try out (for baseball), we had to budget real good to get cleats and a mitt,” said his mother, Linda LaChappa. “There are kids out there with talent. If we could help them with college and stuff, we wanted to do it. “When we started, we thought if it only lasted one year, we'd be successful. But our sponsors have helped us every year. They just continue to support Matthew.” No one is forgotten faster than the former athlete who never made it to the big time. Yet LaChappa's dreams were dashed so dramatically and so abruptly that his legacy has outlived his brief career. His uniform number has been retired at both El Capitan High and Rancho Cucamonga. Oppenheimer said the Padres are considering naming a minor league award in LaChappa's honor. “He could have been a No. 2 or 3 starter in the big leagues,” said Reggie Waller, the former Padres' scouting director. “His fastball could occasionally touch 90 (mph) and he had two curveballs. One of them was just an absolutely major league power curve ball.” LaChappa won 11 games as a starter in Rancho Cucamonga in 1995, compensating for erratic control with a lethal pickoff move. “He would mesmerize guys,” Waller said. “They'd look and next thing they were out.” It happens that quickly sometimes. One moment, you're teeming with opportunity. Then, suddenly, it's all gone, and irretrievable. For LaChappa, the transition was but a twinkling. He was warming up for an April relief appearance against the San Bernardino Stampede when he clutched his chest and collapsed in the bullpen. Derrek Lee, the Padres' No. 1 choice in 1993, would go on to win a World Series, play in an All-Star Game and sign a $65 million contract with the Chicago Cubs. LaChappa, meanwhile, went on to round-the-clock care. “Matthew is doing fantastic,” said his older brother, Eagle. “He actually participates in everything his family does. He attends church, goes to dinner, goes to the movies. “He's still the same person that he was before. Nothing – no matter what happened to him – could get him down. He's always been a fighter.” So, too, is Priscilla Oppenheimer where Matt LaChappa is concerned. “I always buy a foursome in his golf tournament,” she said. “Somebody gave me a little grief about that in a finance meeting, and I had to use some not-so-nice words. But other than that, no one's ever said anything. “The sad thing is most people don't remember who he is now. Most of the staff never dealt with him, so they don't know.” That's a shame, for this is a story that does the Padres proud

  15. POSE FOR PLAYBOY? ASHLEE SIMPSON has a new nose and a new look and is now considering showing it all off in the pages of Playboy, according to media reports in the US. The famous men's magazine has reportedly offered the singer $4 million (GBP2.2 million) to strip for the cameras. A source tells American publication In Touch Weekly the 21-year-old is seriously considering the offer. The insider says, "Ashlee figures she's never looked better, so this may be the perfect time to do it. "She feels confident and sexy and thinks this is one way for her to separate her image from (sister) Jessica's." Simpson's musician boyfriend, BRAXTON OLITA, is said to be supportive of the idea. Now if we could get a spread with Ashlee AND Jessica????? That's worth the cover price

  17. CU To Fire Ward Churchill Professor Has Vowed To Sue If School Fired Him BOULDER, Colo. -- The University of Colorado announced Monday that it will dismiss controversial professor Ward Churchill. "Today, I issued to Professor Churchill a notice of intent to dismiss him from his faculty position at the University of Colorado Boulder," CU Interim Chancellor Phil DiStefano said Monday afternoon. Churchill has 10 days to appeal, which entails making a request to have the university president or chancellor forward the recommendation to the faculty senate Committee on Privilege and Tenure. A special panel will then conduct hearings on the matter and make a recommendation to the president on whether grounds for dismissal are supported. Another committee found Churchill guilty of research misconduct and another panel recommended that he be fired because of "repeated and deliberate" infractions of scholarship rules. Churchill's attorney promptly called a news conference Monday afternoon to announce that his client does intend to appeal to the tenure committee. He also mentioned going to court. Churchill, who ignited a firestorm by calling some of the World Trade Center victims "little Eichmanns" in an essay he wrote after Sept. 11, 2001, has vowed to sue the school if he was fired. "We're going to a real court because we can trust juries to do the right thing," said Churchill's attorney David Lane. "Churchill says this all completely bogus. Let's see if a jury and a Federal District Court agrees with the committee. Or see if everything that's happened here is retaliation for Ward Churchill's First Amendment free speech relating to 9/11." The tenured professor of ethnic studies has repeatedly denied all accusations of misconduct. He told The Associate Press in mid-June, "The basic situation here is that there was a call by high officials in the state, notably the governor but hardly restricted to the governor, for my termination clear back last February, whether or not it was legal. They were willing to take the heat and go to court if necessary to stand behind an illegitimate investigation." When his essay was brought to light in January 2005, Gov. Bill Owens, state lawmakers and relatives of Sept. 11, 2001 victims in New York immediately denounced it. University officials concluded Churchill could not be fired for the essay, but in March 2005 they launched an investigation into allegations of plagiarism and other research misconduct. "A committee last year began to look at his writings including his essay on 9/11," said DiStefano. "We determined his writings were protected under the First Amendment. However, during that process there were allegations of research misconduct." Last month, an investigative subcommittee concluded that Churchill repeatedly fabricated his research, plagiarized others' work and strayed from the "bedrock principles of scholarship." Churchill called the investigation "a kangaroo court" designed to reach the conclusion that he should be fired. "A university is a marketplace of ideas, a place where controversy is no stranger," said Distefano. "An opinioned discourse is applauded. But as is true of all liberties enjoyed by all Americans with freedom, comes responsibility." Owens supported the chancellor's decision in a statement Monday. "I applaud the Chancellor's decision. If the university is the marketplace of ideas, then Mr. Churchill is the rotten fruit among hundreds of good apples," Owens said. "Hopefully we can say good riddance to Ward Churchill once and for all." -------------------------------------------------------------------------------------------------------------------- Goodbye and good riddence :finger :finger
