There would be different problems no doubt. But right now the FDA serves no effective purpose if they aren't fulfilling exactly what their charter is to do. And on top of it, for all of the tax dollars that get dumped into the FDA, there is no way of holding the FDA responsible for what it does. I am a big free market advocate. I honestly believe the threat of huge lawsuits would be enough to keep the drug companies from doing anything too stupid. They could make the arguement to rush something to the market, but when it turned out to have maybe fatal side affects, the companies wouldn't have the FDA to hide behind, they would be drug into court and made to answer with their pocketbooks, just like the cig and aesbestos companies did.

Damn I am glad the FDA protects us against the import of dangerous foreign drugs. The FDA is another bloated worthless bueaurcacy. It needs to be privatized and run by the drug companies. That way when it does fail in its duty to give consumers safe choices, it can be sued in a court of law just like anyone/thing else. It would make the companies think twice about rushing something dangerous to the market, because their would be no hiding behind the FDA.
