HAWKS WIN! HAWKS WIN THE STANLEY CUP!!
G&T replied to southsider2k5's topic in Alex’s Olde Tyme Sports Pub
Wow. This is like a video game. -
QUOTE (Jenksismyb**** @ Apr 26, 2010 -> 06:16 PM) I dunno that a person can be "seized." They can be "falsely imprisoned" via threats/fear of not being able to leave. The 4th Amendment disagrees. This is Terry stop (essentially, what you can search for is state specific). Also, I am pretty sure a police officer cannot falsely imprison because they have proper authority to do so.

QUOTE (NorthSideSox72 @ Apr 26, 2010 -> 05:26 PM) Those are steps, but probable cause still holds to hold someone for a crime. Sure, a cop can ask anyone walking down the street some questions. But said person can also say "no thanks", and keep walking, and that alone is not enough for police custody. You need more. Thus, the intrusion to the point of asking for papers proving they didn't commit a crime (in country illegally), still requires probable cause. And it isn't about handcuffs - its police custody, which is affected not just with phyiscal restraints, but also any condition where a reasonable person would feel they had no right to leave. I'm fairly familiar with the difference between reasonable suspicion and probable cause, particularly as it relates to what actions can be taken by law enforcement. And this law tries to make a bridging leap between them, which will not fly on legal test. You are confusing seizure and custody. Yes, the person is seized if they do not reasonable believed that they can walk away, but that does not mean custody. If he were in custody then he would have to be given Mirandas.

QUOTE (NorthSideSox72 @ Apr 26, 2010 -> 02:06 PM) That will be a key question in any legal questions. Probable cause still needs to be the rule, so if this law works on "suspicion", it probably won't survive a legal test. Probable cause is only necessary to satisfy the warrant requirement and to make an arrest. An officer can approach anyone and ask simple questions if they have "reasonable suspicion." From that point, the answers to those questions can result in a more invasive intrusion, but probable cause is not necessary until the handcuffs are applied. The problem here is that we don't know what articulable facts are acceptable to constitute reasonable suspicion in this case.

QUOTE (jasonxctf @ Apr 26, 2010 -> 02:00 PM) if i understand the law correctly, the following could happen. A hispanic guy is walking back to an apartment building with groceries. A police officer says, hmmm, he may be illegal. He could pull up to the guy and ask him for his papers to prove he's a citizen. Is this correct? There is no "probable cause" just suspicion. No it is not correct, although it might happen in practice. The officer must have articulable facts to justify the intrusion of privacy. You scenario does not contain any such facts.

QUOTE (farmteam @ Apr 23, 2010 -> 07:22 PM) That's not the point though. The point is that, as written (or perhaps more accurately, as what is reportedly written), this law gives local authorities WAY too much leeway in whom they can ask for papers from. And that's not even touching whether or not this law is even within a state's jurisdiction. Yeah this is thorny. The feds have plenary power over immigration so I thought there was field preemption. But I think the argument would be that this is criminal procedure. They aren't charging the person (that would be the feds). Only mandating that the police make inquiry where reasonable suspicion exists.
-
QUOTE (Alpha Dog @ Apr 23, 2010 -> 07:16 PM) Actually, yeah, you probably DO need a law that allows them to ask that. otherwise LaRaza and the ACLU would be howling with indignation every time a latino was asked for ID during a traffic stop. They will still howl, but now they can point to a law that lets them do it. Because every Latino drives with a van full of other Latinos who can't speak English and can't produce licenses? In your scenario such a request for documentation would be constitutionally permissible. The scenario they are after is the one I posted.

QUOTE (Alpha Dog @ Apr 23, 2010 -> 06:51 PM) The bill requires immigrants to carry their alien registration documents at all times and requires police to question people if there's reason to suspect they're in the United States illegally So, if they pull over an old van packed with 14 hispanic looking people in it for speeding, nobody speaks english and they don't have a drivers license or state issued ID, you don't want them asking if they really belong here? You needed a law to question in that situation? The question will be, what does "reason to suspect" mean. My guess would be just beyond the level to make an inquiry. So, if a cop sees a brown guy looking over his shoulder the cop can approach and inquire as to what he's doing or where he is going. If the cop doesn't like the answer, he can ask for papers.

QUOTE (Middle Buffalo @ Apr 21, 2010 -> 12:25 AM) This is as good a place as any to ask what I can eat to assure the biggest "load." My wife is out of town, and I want to surprise her with my performance when she comes back. I ask only because this is probably the second weirdest thread I've seen here. Biggest? Only time can add to the amount. And if you wait, then you'll just be faster. So I don't know if she will be surprised or disappointed...as usual.

Once. Then I turned here. Then I realized Soxtalk is way better. I will never know why someone would rejoin after a banning. It's an internet message board for God's sake.

The Manny excuse, eh? Foxsports

On the street during a night of partying our freshmen year. Turned out we sat next to each other in one of our classes. We didn't date until we were seniors.

QUOTE (iamshack @ Apr 20, 2010 -> 07:40 PM) I think they meant a camera flash. Supposedly Apple thinks Flash is an obsolete technology and refuses to operate with it. Apple thinks it's a resource hog that drains battery. But really they know that if you could play Flash games online, you wouldn't pay for games in the app store.

QUOTE (FlaSoxxJim @ Apr 20, 2010 -> 03:00 PM) 2000 may have been the last time. No that was a bad 2nd half. Only 5 games over. They walked away with the division, but that was the year they clinched in the same game that the Twins hit a walk off homer. That was a weird celebration. Interestingly, though, that 2000 team went 20-7 in June and 17-8 in April. They were a pedestrian team the rest of the season.

QUOTE (3E8 @ Apr 20, 2010 -> 02:30 PM) Are there any good beers available in cans? I'm sick of drinking Keystone Light at our softball games. I guess it would have to be not very heavy Yes. One brewery that comes immediately to mind is Oskar Blues. They have a pils or a pale I think. That will be light enough.

QUOTE (FlaSoxxJim @ Apr 18, 2010 -> 12:38 PM) That sounds great! And simcoes are currently my favorite late addition hop right now as well. Went to a beer festival last night marking the first anniversary of our awesome local new beer bar. Had some very nice beers but the real standout for me was Cigar City's Humidor Series Gruit. Amazing herb mix to complement the hops, the first nose and sip were literally like taking in the essence of a cedar humidor, and then the flavor quickly spreads into all sorts of wonderful botanicals to balance out a medium malt body. Great beer. I didn't know anyone actually sold gruits. It looks like a rare treat.

QUOTE (Leonard Zelig @ Apr 18, 2010 -> 07:40 PM) In1983 the Sox were 12-17, 13-20, 16-24, 25-31. They went on to win 99 games and the AL West by 20 games. I'm guessing that was also the last time they had a good second half. In the last decade, I can't remember the Sox having a strong 2nd half.

What's funny for me is that I didn't even pay attention to the off season really. Didn't care about the start of the season. I have never cared less about the start of the baseball season. Then, on opening day, I thought this team could be good. Why the hell not? A pile of pitching, an adequate offense, and a crap division. But now I'm back to not caring. And maybe that's the worst thing a fan can say. I just don't care about this team. Of course, I don't live in Chicago, so it's a little easier to ignore the games.

QUOTE (Thunderbolt @ Apr 17, 2010 -> 09:12 PM) This Mets game is agonizing, but i can't stop watching. How can you be four hit in 15 innings? Cards have left 18 on base.

Well I'm back in the game tonight after I found a new revenue stream, i.e. a job (at least for now). Anyway, I went in to get Saison Dupont, but I stumbled on Goose Island Night Stalker. Goose Island is making headway into upstate NY recently but I was very surprised to find this, and I'm a sucker for little pieces of home. At $9 a bomber, it was priced fairly. I've already reviewed Saison Dupont, but I haven't seen Night Stalker discussed here. Let me say, it's phenomenal. It is based on Bourbon County Stout, but dry hopped instead of barrel aged. The simcoe hops are noticeable and are the only hop I really care for. I find them less abrasive. They cut through the thick chocolatey malt that pervades this beer. This is a new twist on an impy. I had grown tired of the style, but this is something really nice. The bottle claims that it can be aged 5 years (although I've read that Goose Islands don't make it that long), but good luck saving it.

QUOTE (Soxbadger @ Apr 17, 2010 -> 04:34 PM) Eh last I checked Niemi gave up 1 soft goal last night. The second goal was the defense's failure to clear a puck after they had been pinned in their own zone for about 45 seconds. You cant expect a shut out every night, there is blame to go all around for last game. I agree. It's so easy and routine to blame the goal tending, but the Hawks were outplayed all around in that 3rd period. Hell, everyone knew the goal tending would give up softies and be mediocre at best. That offense and defense were terrible. -
Well it's supposed to be related to professors. In any event, I think I've passed the buck on this one so big win for me.

I was recently asked to help come up with some humorous awards to present to law professors at school. I was wondering if anyone has any ideas? It doesn't have to be law related, but I have no ideas. Anyone?

QUOTE (knightni @ Apr 12, 2010 -> 10:28 PM) Cable? Network TV's always going to be where the money is. Conan's audience doesn't recognize the difference. I think he can have as much success on cable as on network. That might mean less money now, but possibly more success/more money later. And I think TBS is a good spot because his audience probably does sit and watch 3 hours of Family Guy.
